KPK: Court Decision Confirms The Transfer Of Employee Status As ASN In Accordance With Applicable Rules And Conditions

JAKARTA - The Corruption Eradication Commission (KPK) said the decision of the Constitutional Court (MK) further emphasized the process of changing the status of employees to State Civil Apparatus (ASN) in accordance with the rules and regulations.

This was conveyed in response to the Constitutional Court's decision which stated that the implementation of the TWK of KPK employees did not conflict with the 1945 Constitution so that it remained constitutional.

"The Constitutional Court's decision confirms that the KPK has carried out the process of changing the status of KPK employees to ASN in accordance with applicable rules and regulations. In its implementation it involves competent and competent parties," said Acting KPK Spokesperson for Enforcement Sector Ali Fikri to reporters quoted Thursday, September 2nd.

He said that his party has consistently respected the results of examinations and decisions related to the process of transferring the status of KPK employees from other institutions according to their authority. Including, the results of the examination that produces recommendations and judicial decisions that are binding and force to be followed up.

Furthermore, Ali emphasized that the KPK had no problem with submitting a judicial review to the Constitutional Court. He said this was done as a form of the applicant's concern and love for eradicating corruption.

"We are grateful and at the same time hope that the public will continue to support the KPK so that it will never stop working to eradicate corruption, in order to support the realization of a just, prosperous and prosperous society," said Ali.

As previously reported, the Constitutional Court's decision answered the lawsuit Number 34/PUU-XIX/2021 filed by Muh Yusuf Sahide as the Executive Director of KPK Watch Indonesia.

The decision was taken by nine Constitutional Justices, namely Anwar Usman as Chairman and concurrently member, Aswanto, Arief Hidayat, Daniel Yusmic P. Foekh, Enny Nurbaningsih, Manahan MP Sitompul, Saldi Isra, Suhartoyo, and Wahiduddin Adams, each as members.

"Judging, rejecting the applicant's application in its entirety," said Chief Justice of the Constitutional Court Anwar Usman when reading the verdict at the Jakarta Constitutional Court building, quoted by Antara, Tuesday, August 31.

With the rejection of the lawsuit, the Constitutional Court stated that the process of transferring the status of KPK employees through the national insight test (TWK) did not conflict with the 1945 Constitution so that it remained constitutional.
