Alexander Marwata Reported To The KPK Supervisory Board, This Is The Cause

JAKARTA – Deputy Chairman of the KPK Alexander Marwata was reported to the KPK Supervisory Board by representatives of 57 non-active KPK employees. He is suspected of having committed an ethical violation.

"Representatives of 57 non-active KPK employees have sent two letters to the Supervisory Board. The first report is an alleged violation of ethics and behavior by KPK Deputy Chairman AM (Alexander Marwata)," said the representative of 57 employees, Hotman Tambunan, in a written statement in Jakarta, Saturday, 21 August.

According to Hotman, Alexander is suspected of violating the code of ethics and code of conduct for holding a press conference containing defamation or insults for 51 inactive employees on May 25, 2021.

Alex's statement that allegedly violated ethics was "... while the 51 people returned from the assessor, it was already red in color and it was not possible for coaching to be carried out...".

"The statement 'the color is red and can't be trained' that is pinned to these 51 KPK employees who are considered unqualified to become ASN has been detrimental," said Hotman, as quoted by Antara.

According to Hotman, all 51 employees were easily identified by not appointing 75 who were deemed ineligible by the State Civil Service Agency (BKN) and 24 names of employees who were recommended to take part in the training.

Hotman said that the act was alleged to have violated the code of ethics and code of conduct of KPK personnel, namely the basic values of justice, Article 6 Paragraph (2) Letter d; Article 6 Paragraph (1) Letter a; Article 8 Paragraph (2) and Article 4 Paragraph (1) Letter c;

The report on the alleged ethical violation was submitted by seven employees representing 57 KPK employees on August 18, 2021.

They are Harun Al Rasyid, Yudi Purnomo, Sujanarko, Aulia Postiera, Novel Baswedan, Rizka Anungnata, and Rasamala Aritonang.

The employee representative also sent a letter "Application for Supervision of the Implementation of the Ombudsman's Corrective Actions and Komnas HAM Recommendations" on August 19, 2021.

"The Ombudsman of the Republic of Indonesia has conducted an examination in accordance with his authority and stated that there was maladministration in the implementation of TWK in the form of disobedience and neglect of laws and regulations, procedural errors, and abuse of authority," said Hotman.

Meanwhile, Komnas HAM has conducted an examination in accordance with its authority and stated that there were 11 human rights violations against KPK employees in the implementation of TWK in the form of:

The eleven rights that have been violated are the right to justice and legal certainty; women's rights; the right not to be discriminated against; the right to freedom of religion and belief; right to work; right to security.

Furthermore, the right to information; right to privacy; the right to freedom of assembly and association; the right to participate in government; and the right to freedom of expression.

Based on these findings, the Indonesian Ombudsman and the Indonesian National Human Rights Commission have provided corrective actions and recommendations to be implemented by the KPK leadership.

"In connection with the implementation of corrective actions and recommendations from the Ombudsman of the Republic of Indonesia and the Indonesian National Human Rights Commission, I request that the Council can supervise its implementation in a timely manner and to avoid further losses and arbitrary actions against KPK employees," said Hotman.
