KPK Says Not Subject To Any Institution Regarding Ombudsman Correction, Non-Active Employees Disagree: KPK Is Responsible To The Public

JAKARTA - An inactive KPK Public Relations officer who did not pass the TWK, Tri Artining Putri responded to the response of the Deputy Chairperson of the KPK, Nurul Ghufron, who said that his party was not subject to any institution.

Ghufron's statement concerns the KPK's rejection of the findings and corrective steps of the Indonesian Ombudsman regarding the implementation of the TWK which was declared maladministration. According to Putri, the KPK is clearly responsible to the public.

"Pak Nurul (Ghufron) said the KPK is not subject to any institution, it has no superiors. Personally, it's clear, it's very clear that the KPK is responsible for the public," said Putri in a virtual discussion, Sunday, August 8.

Putri then reviewed 3 of the 13 points of KPK's objection to the findings and corrective steps of the Ombudsman regarding employees who did not pass the TWK, namely matters of legal standing, insertion of articles, and socialization.

Putri said that employees who did not pass the TWK still had legal standing to report allegations of maladministration by the KPK leadership regarding their assessment.

"In this case, we employees as citizens make complaints in the form of work administration, so it doesn't mean we don't have the legal standing to file a report on the alleged maladministration related to Perkom Number 1 of 2021 to the Ombudsman," said Putri.

Second, regarding the insertion of the TWK clause, Putri agrees with the Ombudsman. In the process of drafting the Corruption Eradication Commission (Perkom) Regulation Number 1 of 2021 concerning Procedures for Transferring KPK Employees to ASN which began in August 2020, there has been no clause on the implementation of TWK. This clause only appeared on January 25, 2021, or the day before the last harmonization meeting.

The Ombudsman also found procedural irregularities and abuse of authority in the formation of Perkom 1 of 2021, especially during the last harmonization meeting on January 26, 2021. In the meeting, only high leadership positions or designers were present, but also institutional leaders such as the Head of BKN, Head of LAN, Chairman of the KPK, Menkumham, and MenPANRB.

"The TWK article reportedly entered on January 25 or 26 when the harmonization was attended by the KPK leadership directly. In the RI Ombudsman Report, this harmonization should have been attended by high-ranking officials at the Director General's level. Then Pak Nurul said what would be wrong then if the KPK leadership was present," he said.

Third, the KPK leadership claims to have carried out socialization related to Perkom Number 1 of 2021. He emphasized that the findings of the Ombudsman are the same as those of the employees.

"I as a KPK employee can mention here what was uploaded on the KPK internal web, so there are forums there, at the latest KPK portal, we checked. That's right, what was uploaded was the November draft as stated by the Ombudsman. So, November-January has been a lot of changes," explained Putri.
