JAKARTA - Former Spokesman for the Corruption Eradication Commission (KPK) Febri Diansyah asked the Indonesian Ombudsman's recommendation to be carried out by the KPK after being found to be maladministration during the National Insight Test (TWK) assessment.

Febri reminded the KPK not to violate the law because it did not implement the recommendations that had been submitted last Wednesday, July 21.

"Referring to Article 38 of Law Number 37 of 2008 the implementation of the recommendation is mandatory. So do not make excuses for waiting for the decision of the Constitutional Court or the Supreme Court," Febri told VOI, Tuesday, July 27.

"Don't let the KPK violate the law if it doesn't implement the Ombudsman's recommendations," he added.

This anti-corruption activist said that the KPK's steps to implement recommendations do not need to wait for a decision from the Supreme Court and the Constitutional Court because the authority and scope of each institution is different.

Febri reminded the KPK leaders not to add to their series of controversies by ignoring the recommendations of the Indonesian Ombudsman, which they often do.

"Don't let law enforcement agencies disobey the law, especially if they do something against the law," he stressed.

Previously, Acting Spokesperson for the KPK for Enforcement, Ali Fikri, said that his party respected the results of the examination conducted by the Ombudsman. Furthermore, the KPK will study the documents containing suggestions and input for the institution.

However, the KPK did not immediately follow up because they were waiting for the decision of the Supreme Court (MA) regarding the results of the judicial review of Perkom Number 1 of 2021 which became the legal basis for the KPK to carry out the National Insight Test (TWK) as a process of transferring employee status to ASN.

In addition, the KPK is also still waiting for the Constitutional Court's decision on the judicial review of Law 19 of 2020 which was submitted by several parties who did not pass the TWK.

The Indonesian Ombudsman found a number of maladministration and abuse of authority in the implementation of the test as a condition for transferring the status of KPK employees. One of the findings is the manipulation of the date in the memorandum of understanding signed by the KPK and the State Civil Service Agency (BKN).
