JAKARTA - The Indonesian Ombudsman Representative of Greater Jakarta reminded that the burden and responsibility of the Governor of DKI Jakarta Anies Baswedan in enforcing the law during the transitional PSBB period became heavier than before.

Anies did have experience and regulations during the implementation of the PSBB, which took effect from April 10 to June 4. However, the opening of activities outside the 11 existing sectors provides greater supervision and monitoring obligations by the DKI Jakarta Provincial Government.

"The impact of work from home saturation for the middle class and the economic needs of casual daily workers during the previous PSBB period must be anticipated by the DKI Jakarta Provincial Government in the early weeks of this transitional PSBB period," said Chairman of the Greater Jakarta Ombudsman Teguh Nugroho to reporters, Friday, June 5.

The most prominent weaknesses that need to be corrected during the Transitional PSBB are no physical distancing facilities for residents and the enforcement of health protocols in traditional markets.

The lack of awareness of COVID-19 prevention can be seen from the implementation of the first to third phase of the PSBB. Teguh hopes that in the currently ongoing transitional PSBB, the DKI Jakarta Provincial Government can issue a restriction policy in traditional markets.

"PD Pasar Jaya will not become too poor if it only makes social distancing boundaries, supervises the orderliness of the implementation of social distancing by deploying their security personnel, and provides health facilities in these markets," Teguh said.

The same thing should also apply to the locations of the DKI Jakarta Cooperatives, Micro, Small and Medium Enterprises and Trade (KUKMP) Office, parks and crowd centers.

"Locations for street vendors, parks, and public crowd centers must be equipped with social distancing lines and the provision of health protocol tools before being opened in stages as one of the prerequisites for opening the facility," said Teguh.

Furthermore, to date, Anies has yet to issue a Governor Regulation (Pergub) to replace the DKI Governor Regulation Number 33 of 2020 concerning PSBB and Pergub Number 41 of 2020 which regulate sanctions for PSBB violations.

When the PSBB turned into a transitional PSBB, Teguh saw that there was a need to replace regulations from the previous one. These adjustments are related to formal and material aspects.

However, in order for a stronger legal basis regarding sanctions for the community, there must be a formal change in the regulation from a Pergub to a Regional Regulation (Perda).

"This change is necessary so that the Perda can become the basis for law enforcement during the Safe, Healthy and Productive period. This change is important so that local governments have sufficient legitimacy to impose sanctions, including fines that will enter the regional treasury," he explained.
