At National Human Rights Commission, The KPK Leader Explains The Legal Basis For Drafting A Policy For The Transfer Of Employee Status

JAKARTA - Deputy Chairman of the Corruption Eradication Commission (KPK), Nurul Ghufron, completed an examination at the National Human Rights Commission regarding the polemic of the National Insight Test (TWK) which was reported by employees.

Ghufron said that he had conveyed everything regarding the implementation of the TWK. One of them is related to the legal basis for conducting tests for employment status.

In addition, Ghufron as a representative of five KPK leaders explained about the implementation of TWK to the inauguration of their employees as civil servants. This was conveyed in the examination which was held from 10.30 WIB until around 15.00 WIB.

"So we explained to National Human Rights Commission regarding legal standing, the legal basis of authority, then regulatory policies, and the implementation of the transfer of KPK employees to civil servants which was carried out on June 1, 2021", said Ghufron to reporters at the National Human Rights Commission Office, Latuharhary Street, Central Jakarta, Thursday, June 17.

"Then Commission Regulation Number 1 of 2021 was born regarding the Transfer of the Status of KPK Employees to civil servants, which is a regulatory policy", he added.

Furthermore, he stated that the implementation of the TWK was in collaboration with the State Civil Service Agency (BKN). This is also based on the regulations of the commission he mentioned.

"Based on Commission Regulation Number 1/2021 article 5 paragraph 4 that the implementation of the national insight test is carried out by the KPK in collaboration with BKN, that is the basis for its implementation", he said.

Ghufron then detailed that the TWK was carried out in March 2021 until he was finally appointed as a civil servant on June 1, 2021. A total of 1,271 KPK employees have been inaugurated as civil servants while 75 KPK employees have not been appointed because they do not meet the TWK requirements.

"So we explained to National Human Rights Commission regarding legal standing, the legal basis of authority, then regulatory policies, and the implementation of the transfer of KPK employees to civil servants which was carried out on June 1, 2021", he said.

On that occasion, Ghufron also denied the statement that the KPK leadership was absent from the first summons of the National Human Rights Commission.

The reason was that they were not present at that time because they felt the need for legal certainty, namely knowing more clearly what would be asked in the context of an investigation into alleged human rights violations during the TWK.

"We are not absent, we are not absent. However, as mandated in Article 3 of Law 39 of 1999 concerning Human Rights, one of the principles that need to be considered is Article 3 paragraph 2 which states that legal certainty is needed," he said.

As previously reported, the National Insight Test was attended by 1,351 KPK employees. Of these, 1,274 people were declared eligible.

Meanwhile, 75 employees including senior investigator Novel Baswedan, Chairman of the KPK Employee Forum who is also investigator Yudi Purnomo, Director of Socialization and Anti-Corruption Campaign Giri Suprapdiono, Head of the KPK Task Force Harun Al-Rasyid, and Director of Inter-Commission and Agency Network Development Sujarnarko who will retire, was also declared ineligible (TMS). While the other two employees did not attend the interview test.

According to the employees who took this test, there were several irregularities in the implementation of the assessment. Including the questions asked by the assessor or assessor during the interview process.

The employees said the questions asked during the TWK process violated the private sphere. These irregularities were later reported by dozens of these employees to National Human Rights Commission, National Commission for Women, to the Indonesian Ombudsman.
