JAKARTA - The DKI Jakarta High Court (PT) has reduced the sentence of prosecutor Pinangki Sirna Malasari from 10 years to four years in prison in cases of accepting bribes, conspiracy and money laundering.

"The defendant was sentenced to imprisonment for four years and a fine of Rp. 600 million with the condition that if the fine was not paid, it was replaced with imprisonment for six months," stated the Supreme Court's decision page, reported by Antara, on Monday, June 14.

The decision was taken by the chairman of the panel of judges Muhammad Yusuf with member judges Haryono, Singgih Budi Prakoso, Lafat Akbar, and Renny Halida Ilham Malik on June 14, 2021.

"Declare that the defendant Pinangki Sirna Malasari has been proven legally and convincingly guilty of committing a criminal act of corruption as charged in the first subsidiary indictment and money laundering as charged in the second indictment and conspiracy to commit a criminal act of corruption as charged in the third subsidiary indictment," the statement said.

There are a number of considerations by the panel of judges so as to reduce more than half of Pinangki's sentence:

"That the defendant pleaded guilty and said he regretted his actions and has accepted his resignation from his profession as a prosecutor, therefore he can still be expected to behave as a good citizen. That the defendant is a mother of a child who is still a toddler (aged four years) deserves to be given opportunity to nurture and give love to his child in his growing period," said the judge.

Another consideration is that Pinangki as a woman must receive attention, protection, and be treated fairly.

"That the Defendant's actions cannot be separated from the involvement of other parties who are also responsible, so that the level of guilt affects this decision. That the criminal charges of the Prosecutor / Public Prosecutor as the holder of the Dominus Litus principle who represent the state and government are considered to have reflected the community's sense of justice," added the judge.

Previously, the Attorney General's Office demanded that Pinangki be sentenced to four years in prison plus a fine of Rp. 500 million, subsidiary to 6 months in prison.

However, the panel of judges on Corruption Crimes at the Central Jakarta District Court on February 8, 2021 sentenced Pinangki Sirna Malasari to 10 years in prison plus a fine of Rp.600 million subsidiary 6 months in prison for accepting bribes of US$500,000, money laundering, and conspiracy related to the Djoko Tjandra case.

In this case, Pinangki was proven to have committed three criminal acts, namely first being proven to have received a bribe of 500 thousand US dollars from the convict of the Bank Bali "cessie" case, Djoko Tjandra.

The money was given with the aim that Djoko Tjandra can return to Indonesia without having to be sentenced to two years in prison based on the Judicial Review Decision No. 12 dated 11 June 2009.

Pinangki participated in compiling an "action plan" containing 10 stages of implementation to request a fatwa from the Supreme Court (MA) on the decision of the Judicial Review (PK) Djoko Tjandra by including the initials "BR" namely Burhanuddin as an official at the Attorney General's Office and "HA" namely Hatta Ali as an official. in MA at a cost of 10 million US dollars but was only given 500 thousand US dollars as a down payment.

The second act was that Pinangki was proven guilty of laundering US$375,279 or equivalent to Rp5,253,905,036.

The money is part of the bribes given by Djoko Tjandra. The forms of money laundering include buying a blue BMW X5, paying for an apartment rental in the United States, paying for a beauty doctor in the US, paying for a "home care" doctor, paying for an apartment rental, and paying a credit card.

The third act was that Pinangki conspired with Andi Irfan Jaya, Anita Kolopaking, and Djoko Tjandra to promise something in the form of 10 million US dollars to officials at the AGO and the Supreme Court to thwart the execution of Djoko Tjandra as stated in the "action plan".
