SHGB Citypark Can Be Stuck, DKI DPRD Urges Developer to Immediately Hand Over Management

JAKARTA - The controversy over the management of Rusunami Citypark is rolling again. The handover of management and documents from the developer is now an important point because it is needed for the extension of the Building Use Rights Certificate or SHGB and apartment operations.

The issue was discussed during an audience between the PPPSRS Rusunami Citypark and PT Reka Rumanda Agung Abadi or RRAA at the DKI Jakarta DPRD, Kebon Sirih, Friday, August 7.

The meeting was facilitated by Member of Commission D of the DKI Jakarta DPRD from the PSI Faction Bun Joi Phiau. He asked both parties to find a common ground and not let the dispute drag on.

"We hope that both parties can find a common ground. This is not about the interests of one or two people, but about 3,500 residents living in Citypark," said Bun Joi.

He hopes that the problem will be resolved through deliberation without having to go to court.

Bun Joi also reminded the regional government of its authority to provide recommendations and administrative sanctions if the developer's obligations are not carried out in accordance with the provisions.

PPPSRS legal advisor Rusunami Citypark Martin Simanjuntak said the meeting gave a positive signal. According to him, the RRAA party will convey the results of the hearing to the company's board of directors.

PPPSRS requested the handover of the management of land, buildings, common objects, and technical documents that are necessary to extend the SHGB and run the apartment operation.

"What the residents need most at this time is the handover of the management and all supporting documents. That is our priority," said Martin.

He said that the legal path had indeed been taken. However, the process takes time. If the developer is willing to hand over, the dispute is considered still able to be resolved without waiting for a court decision.

On the other hand, legal advisor of PT RRAA Eka Siahaan said that the issue of Citypark has a long history and started from the dispute over the formation of PPPSRS.

According to Eka, there are a number of stages that developers consider not to run according to the rules, including regarding the developer's voting rights in the formation of the PPPSRS management.

"This problem has a fairly long history. There are a number of processes that we think are not in accordance with the provisions of laws and regulations," said Eka.

Despite the different positions, both parties still open up communication spaces. The results of the next meeting will depend on the decision of the RRAA board of directors regarding the request for the handover of management and Citypark documents.
