Supreme Court Aggravates The Sentence Of Ex-KPU Commissioner Wahyu Setiawan

JAKARTA - The Supreme Court (MA) has increased the verdict of former General Election Commission (KPU) commissioner Wahyu Setiawan. Wahyu is a defendant in the bribery case for determining the interim replacement (PAW) of the DPR.

In its decision, the Supreme Court Judges stated that they rejected the cassation application submitted by the Corruption Eradication Commission (KPK) public prosecutor (JPU) but continued to make improvements to the previously imposed sentence.

"According to the Supreme Court, regardless of the reasons or objections to the public prosecutor's appeal, the conviction of the defendant Wahyu Setiawan needs to be corrected," said MA spokesman Andi Samsan Nganro in a statement to reporters, Monday, June 7.

On this basis, the Supreme Court Judges then increased Wahyu's sentence from six years on appeal to 7 years. In addition, the judge also increased the fine imposed from the original Rp150 million subsidiary four months in prison to Rp200 million subsidiary six months in prison.

"In addition, the Supreme Court has also revised the judex facti decision regarding the additional penalty imposed in the form of revocation of the right to be elected in public office from four years to five years," said Andi.

According to the Supreme Court, the circumstances that incriminate Wahyu so that his sentence was increased were that he was an official or state administrator as a member of the KPU. He should be responsible for the election of a good, clean, and honest state administrator.

"The defendant should have worked well, honestly and cleanly, but instead he reneged on his oath of office," said Andi.

He explained that the Supreme Court's decision was pronounced in an open trial on Friday, June 2. Sitting as a panel of judges on cassation is Suhadi as chairman. Then, as judges members Agus Yunianto and Syamsul R. Chaniago.

Previously reported, former KPU commissioner Wahyu Setiawan was sentenced to 6 years in prison and a fine of Rp. 150 million, subsidiary to 4 months in prison by the Panel of Judges at the Central Jakarta Corruption Court.

In his verdict, the judge stated that Wahyu Setiawan was proven guilty and convinced that he accepted bribes together in relation to the management of the Interim Changes (PAW) process for the PDI-Perjuangan DPR member, Harun Masiku.

This decision was later upheld by the DKI Jakarta High Court. However, PT DKI dismissed the KPK prosecutor's demands that Wahyu's political rights be revoked so that the KPK filed an appeal to the Supreme Court.
