During Trial, Rizieq Shihab's Lawyer Played Videos Of Jokowi's Crowd And Bima Arya's TikTok

JAKARTA - Rizieq Shihab's lawyer, Sulistyowati, shows a video of a crowd of President Joko Widodo while in East Nusa Tenggara and Mayor of Bogor's TikTok, Bima Arya Sugiarto.

The two videos were compared with the case of the Petamburan crowd who were both considered not implementing health protocols (prokes).

Initially, Sulistyowati showed a TikTok video of Bima Arya and a video showing President Joko Widodo's work in Maumere. Then, experts namely Panji Fortuna and Hariadi Wibisono were asked to have their opinion regarding the implementation of the health protocols (prokes) in the video.

"Earlier, the expert conveyed how the crowd was related to distance, then what were the consequences and what was the result of this crowd," said Sulistyowati at the trial at the East Jakarta District Court, Thursday, April 29.

Experts Hariadi, when answering, said that the two videos that were played did not apply the process. Because there are moments in the two videos that show not keeping their distance.

Likewise, Panji also stated the same thing. But he could not clearly see whether the public was wearing masks in Joko Widodo's video.

"There is no distance, I can not see wearing a mask or not. If you do not wear a mask, you can make a problem because you have to apply 3 M (washing hands, using masks, and maintaining distance)," Panji replied.

Hearing the expert's answer, Sulistyowati concluded that the crowds of Jokowi and Bima Arya had the same potential to spread COVID-19 as the Petamburan case.

"This means that they have the same potential and do not differentiate between the crowd to another," she said.

In the alleged violation of the health protocol in Petamburan, Rizieq Shihab was charged with incitement to the appearance of a crowd at his daughter's wedding as well as commemorating the Prophet's birthday. This crowd is taking place in the midst of the COVID-19 Pandemic.

Rizieq was charged with violating Article 160 of the Criminal Code in conjunction with Article 93 of Law Number 6 of 2018 concerning Health Quarantine in conjunction with Article 55 paragraph 1 to 1 of the Criminal Code and or Article 82 paragraph 1 in conjunction with Article 59 paragraph 3 letters c and d Law Number 16 of 2017 concerning Community Organization jo Article 55 paragraph 1 to 1 Criminal Code in conjunction with Article 10 letter b Criminal Code in conjunction with Article 35 paragraph 1 Criminal Code.
