Habiburokhman : Discussion Of The Criminal Procedure Code Bill In Commission III Of The DPR RI Is Currently Confirmed To Be Transparent And Participatory

JAKARTA - Chairman of Commission III of the Indonesian House of Representatives, Habiburokhman, emphasized that the discussion of the Draft Criminal Procedure Law (RUU KUHAP) was actually carried out in 2012 but there was a deadlock.

"At that time, the Criminal Procedure Code Bill was referred to by ICW as the KPK killer because of the elimination of investigations and arrangements regarding the Preemptive Examination Judge (HPP) who held power to determine whether or not detention could be carried out and other forced attempts were made. Many parties, especially the KPK itself, have requested that the discussion of the Criminal Procedure Code be stopped," said Habiburokhman in a press statement, Thursday (17/4/2025).

In fact, he said, in 2014 the government and the DPR agreed to postpone the discussion of the Criminal Procedure Code Bill while prioritizing the discussion of the Criminal Code Bill. In the end, the draft of the Criminal Procedure Code cannot be discussed again because the DPR has changed the period three times and the Criminal Procedure Code Bill with Draft in 2012 is not included in the bill that is included in the carry over status as regulated in Article 71A of Law Number 15 of 2019 concerning the Establishment of Legislation Regulations.

This Gerindra politician stated that in the internal meeting of Commission III of the DPR for the Membership Period 2024-2029 dated October 23, 2024, Commission III drafted the Criminal Procedure Law Bill. Commission III then assigned the DPR Expert Board to prepare NA and the Criminal Procedure Law Bill.

In the process of preparing NA and the Criminal Procedure Law Bill, the Expert Board has carried out a series of activities to absorb the aspirations of the community in the form of discussions with law enforcement officials, including Jampidum Asep Nana Mulyana, Expert Staff of the National Police Sector Iwan Kurniawan to Deputy Minister of Law Edward Omar Syarief Hiariej, discussions with a number of NGOs including ICJR, LeIP, IJRS.

"On January 23, 2025, the Indonesian House of Representatives BK held a Webinar with speakers Edward Omar Syarief Hiariej, Jampidum Asep Nana Mulyana, Expert Staff of the National Police Chief Iwan Kurniawan, Professor of FH UNAIR Nur Basuki Wirana, Academician Univ Trisakti Albert Aries, Advocate Magdir Ismail, Advocate Teuku Nasrullah, Chairman of YLBHI Muhamad Isnur. , and law enforcement officials," he continued.

The absorption of people's aspirations continues in Commission III which carried out at least 8 activities to absorb the aspirations of the community, namely a Working Meeting with the Chairman of the Judicial Commission on February 10, 2025, a Hearing Meeting (RDP) with the Chairman of the Criminal Chamber of the Supreme Court of the Republic of Indonesia and the Chairman of the Military Chamber of the Supreme Court of the Republic of Indonesia on February 12, 2025, a Public Hearing Meeting (RDPU) with Advocates namely Maqdir Ismail, Luhut MP Pangaribuan and Petrus Bala Pattyona, on March 5, 2025, Publication of NA and the Bill on the Law of Criminal Procedures through the www.dpr.go.id page on March 20, 2025.

"We also held a press conference related to launching a bill on the Criminal Procedure Law on March 20, 2025, RDPU with Advocates and Academics, namely Juniver Girsang, Julius Hebrew and Romli Atmasmita on March 24, 2025, a press conference related to Articles of Insulting the President in the Criminal Procedure Law Bill can be completed with Restorative Justice on March 24, 2025 and Absorption of Aspiration with PBHI, YLBHI, Amnesty International, LEIP, IJRS, ICJR, LBH Jakarta, AJI, and ILRC on April 8, 2025," he said.

The chairman of the Gerinda faction at the MPR stated that several important things were obtained during the absorption of the aspirations of the community. "The first turned out that the Supreme Court actually rejected the existence of the Preamble Examining Judge (HPP), the second advocate wanted a special article to regulate the immunity of advocates, the third was that all factions agreed that the article on insulting the President at the Criminal Code must be resolved first with RJ and the fourth article on the necessity of obtaining permission to cover the media was removed at the request of the Indepeden Journalists Alliance," he said.

On February 16, 2025, Commission III submitted NA and the Criminal Procedure Law Bill to the leadership of the DPR RI through the Leadership Letter of Commission III of the DPR RI Number B/447-DW/KOM.III/MP.II/02/2025. Furthermore, the plenary meeting on February 18, 2025 agreed on the Criminal Procedure Law Bill to become a bill proposed by the DPR RI.

"Following up on the letter from Commission III, the Chairperson of the DPR submitted NA and the Criminal Procedure Law Bill to the President through Letter Number B/2651/LG.01.01/02/2025 only then the President sent a letter from the President of the Republic of Indonesia to the Chairman of the DPR R-19/Pres/03/2025 dated March 19, 2025 regarding the Appointment of the Deputy Government to discuss the Criminal Procedure Law Bill," he explained.

The next process is the discussion of the KIUHAP Bill in Commission III of the DPR RI officially as regulated in Article 142 paragraph (1) of the DPR's Order, which begins with a Commission III Working Meeting with representatives of the government.

"Before and after the Panja meeting, Commission III will continue to absorb the aspirations of the community. We ensure that all KUHAP discussion meetings will be held in the DPR Building openly and broadcast live by Parliament TV so that it can be followed by people wherever they are. We hope that the public can continue to oversee and participate in the discussion of the Criminal Procedure Code. We hope that we can immediately have a new Criminal Procedure Code which can truly bring justice in the process of criminal proceedings," concluded the senior inj politician.
