Former Ministry Of Religion Official Charged With Corruption Up To IDR 23.636 Billion

Prosecution trial of Defendant Undang Sumantri as Commitment Making Office (PPK) /Antara

JAKARTA - Former Head of General Affairs of the Directorate General of Islamic Education of the Ministry of Religion, UU Sumantri, was charged with corruption in the procurement of computer laboratories and communication systems and integrated learning media at the Directorate General of Islamic Education at the Ministry of Religion for the 2011 budget year, causing losses to the state Rp.

"Defendant Invite Sumantri as Commitment Making Officer (PPK) at the Directorate General of Islamic Education of the Ministry of Religion, together with Affandi Mochtar as Officer of the Signing Order for Payment (PPSPM), Abdul Kadir Alaydrus, Ahmad Maulana, Noufal as Deputy General Manager of Regional Business Service I PT Telekomunikasi Indonesia, Tbk has caused state financial losses of Rp23,636 billion, "said the public prosecutor (JPU) Lie Putra Setiawan at the Jakarta Corruption Court (Tipikor), reported by Antara, Monday, April 26.

First, procurement of Madrasah Tsanawiyah (MTs) computer laboratory equipment at the Directorate General of Islamic Education at the Ministry of Religion for the 2011 Fiscal Year with a ceiling value of Rp. 31.68 billion with details of 400 packages and a unit price of Rp. 79.2 billion.

Initially, a former DPR member from the Golkar Party faction said that there was a project for the MTs computer laboratory equipment for FY 2011 which is "owned" by Senayan and Zulkarnaen Djabar has appointed Fahd El Fouz to "guard it".

Fadh then offered the project to the Director of PT Sinergi Pustaka Indonesia, Abdul Kadir Alaydrus. Abdul Kadir then offered the job to Ahmad Maulana (owner of PT Cahaya Gunung Mas). Furthermore, Ahmad Maulana used the company name PT Batu Karya Mas to participate in the auction process because his PT Cahaya Gunung Mas also did not have the ability to do it.

Abdul Kadir then handed over a "fee" to Fadh in the amount of Rp4.74 billion. Invite then met Affandi and Affandi said that the winner of the auction was "the Senayan party".

On November 16, 2011, Fadh, Vasko Ruseimy, Syamsurachman who claimed to be the Senayan envoys met with UU with Bagus Natanegara, Mohammad Zen, Dadan Abdul Rahman. At the meeting Fahd requested that PT Batu Karya Mas be announced as the winner of the procurement of MTs computer laboratory equipment for the 2011 FY.

"The defendant on November 30, 2011 signed a work agreement with a contract value of Rp. 31.204 billion with a period of 30 calendar days, namely November 30 - December 29, 2011," said the prosecutor.

However, until the end of the contract, there were still 24 out of 400 MTs that received the computer laboratory equipment package, but UU still paid for the work worth IDR 31.204 billion while the purchase of goods by PT Batu Karya Mas was only IDR 14.716 billion.

"For this work, Affandi Mochtar received Rp200 million from Abdul Kadir Alaydrus and enriched PT Cahaya Gunung Mas by using the company PT Batu Karya Mas and resulted in a state financial loss of Rp.13.65 billion," the prosecutor added.

Second, the procurement of the Development of Integrated Learning Media and Communication Systems for MTs and Madrasah Aliyah (MA) levels at the Directorate General of Islamic Education of the Ministry of Religion for the 2011 budget year.

The value of the procurement of integrated communication systems and learning media for the MTs level is IDR 23.017 billion with a volume of 150 packages with a unit price of IDR 153.45 million.

Meanwhile, the procurement value of the communication system and integrated learning media for the MA level is IDR 43,242 billion with a volume of 175 packages with a unit price of IDR 247.1 million.

As with the previous procurement package, Zulkarnaen Djabar asked Fahd El Fouz to become the procurement intermediary.

In October 2011, Fadh met with the Deputy General Manager of Business Service Regional I of PT Telekomunikasi Indonesia, Tbk Noufal and offered the project on the condition that Noufal paid a "fee" of 15 percent of the total ceiling.

For this reason, on November 4, 2011, Noufal handed over a check worth Rp3 billion to Fahd El Fouz through Syamsurahman.

Affandi Mochtar then conveyed to the Law that the winner of the auction was "Senayan".

So that on November 17, 2011, PT Telekomunikasi Indonesia, Tbk was declared the winner of the tender for the procurement of integrated communication systems and learning media development for the 2011 MTs level with an offering value of IDR 21.959 billion.

Meanwhile, on November 15, 2011, PT Telekomunikasi Indonesia, Tbk was appointed as the winner of the tender for the procurement of communication systems development and integrated learning media for the 2011 Supreme Court level with an offering value of IDR 41.565 billion.

The total contract value for the two procurements amounted to IDR57.75 billion.

However, it turns out that PT Telekomunikasi Indonesia, Tbk. transferred the work to PT PINs so that the total work transferred was Rp. 52,654 billion.

PT PINs also diverted part of the 2 procurement works by entering into contracts and purchases to 11 vendors providing goods with a total amount of Rp. 47.763 billion.

In its implementation, for the MTs level there is still a shortage of jobs in the form of an audio set that was just sent to the location, only 2.67 percent, while for the MA level the audio set that was just sent to the location was only 19 percent.

However, on December 28, 2011, a 100 percent payment was realized to the account of PT Telekomunikasi Indonesia with a total amount of Rp57.75 billion. For this payment, Affandi Mochtar received around Rp. 50 million from Noufal.

As a result of UU's actions together with Affandi Mochtar and Noufal in the implementation of an integrated communication system and learning media at the MTs and MA levels in 2011, it has enriched a number of parties, namely (1) PT. Telekomunikasi Indonesia, Tbk amounting to Rp5,095 billion and (2) PT. Pramindo Ikat Nusantara (PT PINs) amounting to IDR4.89 billion, causing state losses of IDR9.986 billion.

The total state loss from the three projects is IDR 23,636 billion, with details:

1. To enrich PT Cahaya Gunung Mas (using the company PT Batu Karya Mas) in the amount of Rp. 13.65 billion

2. Enriching PT. Telekomunikasi Indonesia, Tbk in the amount of Rp5,095 billion

3. To enrich PT Pramindo Ikat Nusantara (PT PINs) in the amount of IDR4.89 billion

For his actions, the Law was charged under Article 2 paragraph (1) or Article 3 of Law No. 31 of 1999 as amended by Law 20 of 2001 concerning Eradication of Corruption in conjunction with Article 55 paragraph (1) 1 of the Criminal Code in conjunction with Article 65 paragraph 1 of the Criminal Code.

This article regulates a person who violates the law, abuses the authority, opportunity or means available to him in his position or position so that it can harm the country's finances and economy and enrich himself, other people or corporations with the threat of imprisonment of a maximum of 20 years and a maximum fine of Rp1 billion.
