Pengmiluan Expert Calls Not All Administrative Violations Ended In Re-voting

JAKARTA - A electoral expert from the University of Indonesia, Titi Anggraini, said that not all violations of procedures at polling stations (TPS) must end the re-voting (PSU). This process should be carried out specifically and has a strong legal basis.

This was conveyed by Titi when she was an expert witness in the dispute over the results of the 2024 North Barito Regional Election at the Constitutional Court on Friday, February 14, 2025.

Initially, he mentioned that voters on the final voter list (DPT) were actually legitimate in voting even though they did not show an electronic ID card. Provided, the Notification-KWK Model C Form is still being brought.

"I am of the view that after referring to all existing regulations and the flow of how the Notification-KWK Model C Form arrives at the hands of voters, the voters are entitled to vote," said Titi.

Moreover, if the voter is recognized by KPPS officers, witnesses, and TPS supervisors, it means that the factual truth has been fulfilled.

"Yangni berdasarkan fakta yang dapat diverifikasi dan dipertanggungjawab bahwa yang bersangkutan memang punya hak pilih dan memberikan suara satu kali," tuturnya.

Titi said there was a very long process so that the Model C Notification Form-KWK could reach the hands of voters.

This condition then made Titi say that not all violations of procedures at the TPS must be followed up with the PSU.

"KPPS that allows voters to bring the Model C Form Notification-KWK using their voting rights is indeed an administrative violation."

"However, not all administrative violations must be carried out by the PSU," said Titi.

PSU, continued Titi, should have been carried out if there were more specific violations.

"This is related to efforts to prevent the distortion of voters or changes in intensity due to different conditions between the simultaneous voting day and the time during the PSU because the final results have been illustrated."

"In addition, it is also to prevent the spread of fraud due to PSU, such as money politics, intimidation, and corruption," said Titi.
