President Releases Rules To Strengthen Protection For Workers Affected By Layoffs

JAKARTA - President Prabowo Subianto has signed Government Regulation (PP) number 6 of 2025 which is intended to strengthen protection or protection and provide better guarantees for workers affected by layoffs (PHK).

In a copy of the regulation reported by ANTARA, Friday, February 14, this regulation contains Amendments to Government Regulation number 37 of 2021 concerning the Implementation of the Job Loss Guarantee Program.

In general, this new regulation includes changes to the provisions regarding the requirements for the participation of job loss guarantees (JKP), expiration of claims, import requirements, and evidence of layoffs.

There are nine articles that have changed, including Article 4, Article 11, Article 19, Article 20, Article 21, Article 25, Article 31, Article 39, and Article 40.

There is also one additional provision, namely Article 39A whose position is inserted between Article 39 and Article 40 with two verses.

The purpose of changing the regulation by the Government is expected to be able to optimize the protection of workers for those who have lost their jobs or have been affected by termination of employment (PHK) through JKP.

In addition, changes are felt to be important to reduce social risks for workers who have experienced layoffs in the midst of current economic conditions and the level of layoffs in companies that are considered high.

Some significant changes can be seen in this regulation, namely that there is a change in the level of the JKP program contribution which was previously regulated to be paid by 0.46 percent of the monthly wage, now the figure has been changed to 0.36 percent.

There is also a change in the application for the JKP benefit claim time which was extended to six months from the previous three months since a worker was laid off.

Meanwhile, the provisions added are Article 39 for Paragraph (1) which reads, "In the event that the company is declared bankrupt in closing in accordance with the provisions of the legislation and in arrears of dues no later than 6 (six) months, the benefits of JKP will still be paid by BPJS Ketenagakerjaan".

Meanwhile, paragraph (2) reads, "The provision for payment of benefits for JKP as referred to in paragraph (1) does not erase the obligation of Entrepreneurs to pay arrears and fines for the employment social security program".

This rule was signed by the President of the Republic of Indonesia Prabowo Subianto on February 7, 2025 and promulgated on the same day by the Minister of State Secretary Prasetyo Hadi.

This regulation also regulates that ministries that organize government affairs in the employment sector, BPJS Ketenagakerjaan, and BPJS Kesehatan must adjust the JKP participation no later than 15 working days after official regulations take effect.

After promulgated all implementing regulations from Government Regulation number 37 of 2021 concerning the Implementation of the Job Loss Guarantee Program, it is stated that it will remain valid as long as it does not conflict with the provisions in this Government Regulation.
