Komnas HAM: Anggoota TNI Shoots Car Rental Boss 'Extra Judicial Killing'

JAKARTA - The National Human Rights Commission stated that the shooting of the car rental boss at the Restometer 45 of the Tangerang-Merak Toll Road by members of the Indonesian Navy on Thursday (2/1) was an act of murder outside the legal process (extrajudicial killing).

"The actions of Indonesian Navy soldiers are killings outside the legal process or court decision," said the Coordinator of the Human Rights Enforcement Sub-Commission, Komnas HAMUli Parulian Sihombing, in a statement reported by ANTARA, Thursday, February 6.

Komnas HAM assessed that the action was extra judicial killing because the shooting was carried out by members of the Indonesian Navy when they were not on duty or carrying out orders from the law, and not in the context of self-defense. The shooting was known to have resulted in one person dying and one person being injured.

"Not in carrying out the law's orders, Indonesian Navy personnel are not carrying out the law's orders to shoot the victim," said Uli.

In addition, Komnas HAM also stated that the incident was a violation of the right to justice. This is because the reports and police complaints that were submitted by the victim before the incident were not followed up.

"There is no follow-up of reports or complaints or police information from Brother IAR resulting in violations of the right to justice, namely the right of everyone to be processed for reports of alleged criminal acts based on the provisions of the legislation," explained Uli.

Based on this, Komnas HAM recommended the Jakarta Military Court II-08 to try and examine the case independently, implicitly, transparently, and objectively.

Komnas also recommends that the TNI evaluate the regulations for the use of firearms, especially in terms of supervision, socializing the regulation on the use of firearms, and conducting psychological assessments of soldiers who use weapons regularly.

Komnas HAM recommends that the Witness and Victim Protection Agency (LPSK) protect witnesses and victims, as well as seek the recovery of victims.

"Komnas HAM appreciates its investigation, investigation, and prosecution efforts, both for civilian and military cases that have been carried out by the Tangerang Police, Puspomal, and Oditur II-08 Jakarta," added Uli.

The shooting incident of the car rental owner occurred at the KM 45 area of the Tangerang-Merak Toll Road in the early hours of Thursday (2/1). In that incident, the car rental boss, IAR, died from gunfire in the chest, while his employee, RAB, was injured.

On Friday (3/1), the police secured rental car tenants, namely AS and IS, in the Pandeglang area, Banten.

Following the arrest, the shooter who was a member of the Indonesian Navy was also arrested by Navy Military Police (Pomal) personnel, namely the initials Sertu AA, Sertu RH, and KLK BA.
