Passing The Deadline, The Pemalang Regional Head Election Lawsuit Vicky Prasetyo Was Not Accepted By The Constitutional Court

JAKARTA - The Constitutional Court (MK) stated that it could not accept the lawsuit of the Candidate Pair for the Regent and Deputy Regent of Pemalang Number 1 Vicky Prasetyo and Mochamad Suwendi who questioned the results of the 2024 Pemalang Pilkada.

"Declaring the case 115/PHPU.BUP-XXIII/2025 is unacceptable," said Chief Justice of the Constitutional Court Suhartoyo reading out the dissal decision in the Court Building I Session Room, Jakarta, Wednesday, February 5, which was confiscated by Antara.

Suhartoyo explained that the application for Vicky and Suwendi passed the grace period stipulated in Law Number 10 of 2016 concerning Regional Head Elections and Constitutional Court Regulation Number 3 of 2024.

The deadline for submitting a regional election dispute application is three working days from the time the KPU announced the determination of the vote acquisition for the election results.

The Pemalang Regency KPU determined the results of the election for local regents and deputy regents on December 3, 2024, while Vicky registered his application on December 6, 2024.

"So, the exception regarding the grace period for submitting the application is legally reasonable. Therefore, regarding other exceptions, legal standing, the main petitioner's petition, and other things are not considered because they are considered to have no relevance," Suhartoyo said.

Previously, the couple Vicky Prasetyo and Mochamad Suwendi said there was a ballot box stored in the KPU toilet in Pemalang Regency, Central Java, during the vote count of the 2024 Pemalang Pilkada.

"During the vote count, several ballot boxes were found in the Pemalang Regency KPU toilet which was stored as if to be destroyed," said Vicky-Suwendi's attorney, Marloncius Sihaloho, in the inaugural trial, Thursday, January 9.

With the discovery of the letter box, Vicky-Suwendi suspects that the Pemalang Regency KPU is trying not to count all incoming votes. The famous person admitted that he was suspicious of the Pemalang Regency KPU who was the defendant in this case.

In addition, Vicky-Suwendi admitted to finding the practice of money politics in the 2024 Pemalang Pilkada. According to them, candidate pair number 3 Anom Widiyantoro-Nurkholes distributed money before the election day.

Based on these arguments, Vicky-Suwendi asked the Constitutional Court to cancel the results of the 2024 Pemalang Pilkada set by the local KPU. He also asked the Constitutional Court to order the re-implementation of the Pemalang Pilkada in a transparent and honest manner.
