Different Opinions Of The Former Minister Of Law And Human Rights And The Attorney General's Office Regarding Expert Authority In Tin Cases

The polemic surrounding the authority of the Professor of the Bogor Agricultural Institute (IPB), Prof. Bambang Hero Saharjo in calculating state losses related to the corruption case of tin mines in Bangka Belitung (Babel) continues.

Former Minister of Law and Human Rights (Menkumham), Amir Syamsudin said that based on Article 4 Paragraph 2 of the Regulation of the Minister of Environment Number 7 of 2014, Ahii should be appointed by echelon I officials whose duties and functions are responsible in the field of environmental law enforcement of the Central Environmental Agencies or echelon II officials of regional Environmental Agencies.

"As long as there are no changes, it will still apply as stated in the regulation. It cannot be interpreted differently. The regulation was prepared with a study, not carelessly," he said in an official statement, Sunday, January 12.

This was said by Amir in response to the polemic of his police Bambang Hero Saharjo regarding the results of the calculation of environmental losses in the Rp271 trillion tin corruption case, which dragged the name of the husband of Sandra Dewi, Harvey Moeis.

Amir emphasized that in accordance with the Minister of Environment Number 7 of 2014, the authority to conduct audits is the domain of officials within environmental agencies, not the investigator's authority.

Meanwhile, Amin is the former Minister of Law and Human Rights who signed the Minister of Environment and Environment Number 7 of 2014.

Amin's statement is not in line with what was revealed by the Head of the Legal Information Center of the Attorney General's Office, Harli Siregar. Harli emphasized that the court had determined state losses of up to Rp. 300 trillion and supported the prosecutor's charges.

According to Harli, the court's decision agrees with the Public Prosecutor (JPU) who stated that there was a state loss due to environmental damage in the case.

"Yes, all parties must obey the principles. The expert provides his statement on the existing knowledge which is then processed and calculated by the state auditor. The calculation of the state's financial losses is based on the request of the investigating prosecutor," said Harli.
