Semarang District Court Becomes A Public Spotlight After Rejecting 3 PKPU Applications

JAKARTA - Semarang (PN) has been in the public spotlight regarding the rejection of a number of requests for Postponement of Debt Payment Obligations (PKPU) on the grounds that the case is not simple, even though the defendant is the same.

This rejection arose after three PKPU applications were rejected by the Semarang Commercial District Court. The first application was registered with Case Number 2/Pdt.Sus-PKPU/2024 submitted by Ariq Roas, the second application Number 8/Pdt.Sus-PKPU/2024 submitted by PT Cuan, and the third application Number 14/Pdt.Sus-PKPU/2024 also suffered a similar fate. These three cases involved the same defendant, namely PT Indo Energy Solution (PT IES).

This case arose regarding the sale and purchase of oil involving PT. Cemerlang Usaha Agri Nusantara (PT CUAN) with PT IES as a buyer. In the middle of the trip PT IES could not pay invoices for the purchase of oil from PT Cuan. Not only that, PT IES also cannot pay invoices from other creditors, namely Ariq Ro'is, PT Alami Vinteg and PT Bengkulu Sawit Lestari

The rejection sparked objections from the plaintiff, one of which was PT Cuan's attorney, Agus Nurudin. He admitted that he was harmed by the judge's decision which was considered unfair. Agus considered the judge not to be careful in seeing the facts at trial.

"We feel aggrieved by the rejection of this PKPU application. It is as if the data and facts of the trial that we have conveyed have been ignored, even though there are clearly irregularities committed by the defendant," said Agus, in a written statement received, Thursday, December 5, 2024.

It is the duty of the court to decide the case fairly, not to protect the defendant from the snares of the law," he added.

Meanwhile, the Public Relations of the Semarang District Court, Hadi Sunoto, denied any protection from certain parties. He emphasized that his party upholds neutrality in handling cases.
