Chief Justice Of The Constitutional Court Predicts There Will Be More Than 300 Cases Of Pilkada Dispute

JAKARTA - Chairman of the Constitutional Court (MK) Suhartoyo predicts that there will be more than 300 cases of Dispute over the results of the 2024 Governor, Regent and Mayor Elections or regional election disputes that will enter, given the large number of pairs of regional head candidates this year.

"The projection is around 300 more. Maybe it will be more, it could be less, but because this is the partner of thousands, it could be more, yes," Suhartoyo said when met at the Constitutional Court Building, Jakarta, Antara, Monday, November 25.

Suhartoyo said the number of cases that came in depended on public trust with the Constitutional Court. According to him, every pair of candidates has the right to choose to register or not register the dispute over the election results with the Court.

"People filing a lawsuit in the Constitutional Court are how the Constitutional Court records (in experience) in handling (disputes) the presidential and legislative elections. If they are still confident, it may bring the issue of regional elections to the Constitutional Court. But if they choose not to bring the choice, it's their respective candidate pairs," he said.

Apart from the number of cases to enter, Suhartoyo ensured that the Constitutional Court had made a number of preparations, ranging from workshops to simulations. He also said that there was no special preparation in dealing with this regional election dispute.

"Saya kira secara prosedur kemudian teknik itu juga tidak jauh berbeda dengan penanganan perkara legislatif kemarin. Jadi. tidak ada persiapan khusus, persiapan ini persiapan yang biasa saja yang seperti saat penanganan PHPU (perkara perjuangan hasil pemilihan umum) kemarin," tuturnnya menjelaskan.

As an establishment for the Constitutional Court's preparation for the regional election dispute, Suhartoyo inaugurated 735 personnel from the task force for handling the 2024 Pilkada dispute on Monday. The task force will work from 27 November 2024 to 14 March 2025.

He explained that the task force will work collectively collegially, starting from receiving case registration to the mitation process after the case is decided. With the inauguration of this task force, the Chief Justice of the Constitutional Court is optimistic that his party will be more prepared to face the 2024 Pilkada dispute

"God willing, it will be more prepared, because this is also a formal requirement, right. If we don't practice it, then in the hearts of our friends, we don't have a sense of responsibility that must be carried out in accordance with what was pronounced in the oath earlier," Suhartoyo said.

It is known that the Constitutional Court will receive registration for regional election disputes for a maximum of three working days after the KPU announces the determination of the vote results. This means that the registration of regional election disputes is opened by the Constitutional Court in the November 27 range December 18, 2024.

In resolving incoming cases, the Constitutional Court was given a maximum deadline of 45 working days since the application was recorded in the Electronic Constitutional Case Registration Book (e-BRPK).
