Mardani Maming's Sentence Reduced To 10 Years In Prison After Supreme Court Grants PK

JAKARTA - The Supreme Court (MA) granted the request for a judicial review (PK) filed by the convict Mardani Maming. The sentence of the former Regent of Tanah Bumbu was reduced from 12 years to 10 years in prison.

"Trial: Granting a request for Review from the Petitioner for Review from the Application for Review / convict Mardani H. Maming; - Cancel Supreme Court Decision Number 3741 K / Pid.sus / 2023 dated August 1, 2023," as reported from the MA Kepanteraan website, Tuesday, November 5.

Case number: 1003 PK/Pid.Sus/2024 is examined and tried by the Chairman of the Prim Council Haryadi with member judges Ansori and Dwiarso Budi Santiarto, as well as Dodik Setyo Wijayanto as the Substitute Registrar. This decision was read out on Monday, November 4.

Prim is known to replace Sunarto who was later inaugurated as Chairman of the Supreme Court. "Imposing a sentence to the convict Mardani H. Maming is therefore sentenced to 10 years in prison and a fine of Rp. 500 million with the condition that if the fine is not paid, it will be replaced with imprisonment for four months," he said in the verdict.

In addition, Mardani was also sentenced to pay a replacement money of Rp110,604,731,752. If he did not pay then his property was confiscated and auctioned off.

And if the convict does not have sufficient assets to pay the replacement money, he will be sentenced to imprisonment for two years, "as stated in the verdict.

"Determining the detention period that has been served by the convict is deducted entirely from the sentence imposed," continued the judge.

As previously reported, the Supreme Court rejected Mardani Maming's cassation, who is the former Regent of Tanah Bumbu. He was still sentenced to 12 years in prison plus a fine of Rp. 500 million, subsidiary to four months in prison.

This verdict strengthens the decision of the Banjarmasin High Court (PT). Mardani is said to have received a bribe of Rp. 118 billion related to the coal operations mining business permit (IUP OP) PT Bangun Karya Pratama Lestari (BKPL) to PT Prolindo Cipta Nusantara (PCN).

He is said to have played an active role in streamlining the process. Mardani Maming even said to have ordered, made, and signed the Tanah Bumbu Regent Decree Number 296 of 2011 concerning the Approval for the Delegation of Coal OP IUP PT BKPL Number: 545/103/IUPOP/D.PE/2010 to PT PCN.
