KPK Hopes Capim And Supervisory Board Are Chosen Through A Process That Is In Accordance With The Rules

JAKARTA - The Corruption Eradication Commission (KPK) hopes that prospective leaders and supervisory boards will be selected through a process that is in accordance with the rules. So that in the future, this position can be occupied by the best people to boost their performance.

This was conveyed by KPK spokesman Tessa Mahardika when asked about the DPR RI which has not processed the names of 10 candidate leaders and the names of the 10 candidates for the supervisory board that have been submitted.

"We, this country needs from these candidates to be selected through a process that is in accordance with the rules and can produce leaders and supervisory boards who can bring the KPK to work better in the future," Tessa told reporters, Wednesday, October 30.

Tessa said her agency submitted the process of selecting candidate leaders and supervisory boards entirely to the DPR RI. The authority rests with the legislators.

"The KPK, in this case, only wants the best of the process regardless of what and how the process is under the authority of the executive and legislature," he said.

"My investigation, as stated in the past, we want the best of the best, of course from 10 KPK candidates and 10 supervisory board candidates," continued the spokesman with the investigator's background.

The DPR previously stated that the presidential letter (surpres) regarding the candidates for leadership and candidates for the KPK supervisory board had been received. Deputy Speaker of the House of Representatives, Sufmi Dasco Ahmad, said the file was already at the desk of the Chairman of the Indonesian House of Representatives, Puan Maharani.

"Yes, I heard yesterday that it was at Mrs. Puan's desk," Dasco told reporters, Thursday, October 24.

However, his party has not discussed the mechanism to follow up on the presidential decree. Discussions will be held in a leadership meeting.

Meanwhile, many parties consider the surpres to contain the name of a candidate for leadership and supervisory board submitted by President Joko Widodo (Jokowi) before stepping down the problem. One of them is the Coordinator of the Indonesian Anti-Corruption Society (MAKI) Boyamin Saiman who wrote to President Prabowo Subianto asking the selection committee to be reshaped.

"The contents of the letter are an application to Mr. Prabowo to form a new selection committee for KPK leadership candidates and candidates for the KPK Supervisory Board, because only Prabowo is authorized to form the KPK Pansel and ignore the results formed by Jokowi," said Boyamin in his statement, October 22.

Boyamin said the letter was sent via goods delivery service on Monday afternoon, October 21. "Only Mr. Prabowo has the authority to form the KPK Pansel and ignore the results formed by Jokowi," he said.

Furthermore, the DPR also said that it was enough to archive the letter that had been sent by Jokowi. This is because the 7th President of the Republic of Indonesia is considered not entitled to form a Pansel Capim and members of the KPK Council, let alone submit it to legislators for compliance and feasibility tests or fit and proper tests.

Boyamin said that this authority actually existed with Prabowo as regulated in the decision of the Constitutional Court (MK) Number: 112/PUU-XX/2022 page 117 of the last paragraph and 118 of the first paragraph. Here are the details:

"That the term of office of the KPK leadership given by Article 34 of Law 30/2002 for four years and can be re-elected for one term of office has turned out to have resulted in one term of office of the President and the DPR, namely that during the five years in cash for the 2019-2024 period, two assessments of KPK institutions, namely in terms of selection or recruitment of KPK leaders.."

In this case, institutionally, the KPK is treated differently from other supporting state institutions but belongs to the institutional importance which is both independent and formed based on the law because of the independent institutional importance which has a five-year tenure, it is considered as one time during the term of office of the President and the DPR.
