Administrative Court Postpones Reading Decision On Gibran's Candidate Lawsuit Until October 24

JAKARTA - The Jakarta State Administrative Court (PTUN) has postponed the reading of the verdict related to Gibran Rakabuming Raka's candidacy as vice president in the 2024 presidential election for 2 weeks.

"The decision was postponed until October 24 due to the chairman of the panel being sick," said PDI-P legal team memberGayus Lumbuun, quoted by ANTARA, Thursday, October 10.

Thus, decisions regarding the validity of Gibran Rakabuming Raka's candidacy will be read out after the Inauguration of Presidential and Vice President Elected in the 2024 General Elections Prabowo Subianto and Gibran Rakabuming Raka become Presidents and Vice Presidents of the Republic of Indonesia for the 2024 period. 2029 on October 20 next.

Based on the official website of the Jakarta Administrative Court, the case which was registered with number 133 / G / TF / 2024 / PTUN.JKT should have been decided at 13.00 WIB electronically via e-court.

In this case, the PDI-P filed a lawsuit with the Administrative Court because it considered the KPU to have committed a legal act in the 2024 presidential election process.

The PDI-P has asked the Jakarta Administrative Court to declare the KPU's actions as the organizer of the 2024 General Election as long as the presidential and vice presidential elections are unlawful acts by government officials (onrechtmatic overheidsdaad).

The KPU's actions, which were questioned by the PDI-P, basically did not reject the registration of Gibran Rakabuming Raka as a candidate for vice president to participate in the 2024 General Election. The KPU was deemed to have violated the legislation when carrying out the Constitutional Court's Decision Number 90/PUU-XXI/2023, regarding the age requirements for presidential and vice presidential candidates.

In its petitum, PDI Perjuangan also requested that the Administrative Court oblige the KPU not to take administrative action as long as it is related to the interests of the inauguration of the elected vice president candidate for the 2024 '2029 period on behalf of Gibran Rakabuming Raka.

Meanwhile, the KPU through its attorney, Saleh, is optimistic that it will win against the PDI-P lawsuit at the Jakarta State Administrative Court (PTUN) in connection with alleged unlawful acts in the 2024 presidential election.

According to Saleh, the PDI-P lawsuit material has been completed at the Constitutional Court (MK) through a decision in the case of dispute over general election results (PHPU) filed by the Anies Baswedan-Muhaimin Iskandar pair and the Ganjar Pranowo-Mahfud Md pair.
