YOGYAKARTA The discussion about the seizure of the position of Chairman of the Indonesian Chamber of Commerce and Industry (Kadin) between Arsjad Rasjin and Anindya Bakrie is still ongoing. The reason is, until now it is not clear whether Anindya Bakrie is a valid leader of Kadin.

On the other hand, Arsjad is still fighting against the movement that tries to remove him from the position of chairman of Kadin 2021-2026.

According to Arsjad, the implementation of the Munaslub which appointed Anindya as the Head of Kadin for the period 2024-2029 had violated the Indonesian Chamber of Commerce and Industry's Articles of Association and Bylaws (AD/ART).

For this reason, Arsjad stated his attitude to stick to the AD/ART of the Indonesian Chamber of Commerce and Industry based on Law Number 1 of 1987 and Presidential Decree (Keppres) Number 18 of 2022, especially in leading the Indonesian Chamber of Commerce and Industry as the only forum organization for the business world.

"There is only one Indonesian Chamber of Commerce and Industry, namely the Indonesian Chamber of Commerce and Industry whose basis for organizing it is stipulated through Law 1 of 1987 concerning the Indonesian Chamber of Commerce and Industry and Presidential Decree (Keppres) Number 18 of 2022. Therefore, all forms of activities of the Indonesian Chamber of Commerce and Industry, including the implementation of the National Conference, must comply with the provisions of the Law and the mandate of the AD/ART," said Arsjad in an official broadcast by Kadin, Sunday, September 15, 2024.

In this regard, the Head of the Jakarta Kadin Munaslub Organizer, Bayu Priawan Djokosoetono, said that the Kadin Munaslub who appointed Anindya Bakrie as Chairman of Kandin had a legal standing.

"In terms of implementation (Munaslub Kadin), everything has been done according to the correct AD/ART and nothing has been violated," said Bayu Priawan in the Indonesian Greeting Morning Kompas TV dialogue with the title "What's Behind the Chaos of Kadin's Breaking, on Friday, September 20, 2024".

"And if it is said that the implementation of this Munaslub is illegal, it is actually not appropriate, because indeed we have officially obtained permission from the police to be able to carry out this Munaslub," said Bayu again.

He said the implementation of the Munaslub was also carried by extraordinary members who were in Kadin. The reason is that Kadin needs to make changes to be more able to synergize with the government.

"Because the name Kadin must be able to synergize well with the government," he said.

Bayu continued, the Munaslub activity that appointed Anindya was not something that suddenly happened.

"This effort is actually not impromptu, it's been quite a while, it's been a process, it's just that the momentum hasn't been found in the past and there are also communication processes that the Kadinda also associate with Ketum Arsjad," explained Bayu.

"But apparently the communication was not carried out well, so in the end Kadinda and also the extraordinary Kadin members, this association finally urged the implementation of the Munaslub," he continued.

Unlike Bayu, the attorney for the Indonesian Chamber of Commerce and Industry, Hamdan Zoelva, called the munaslub who appointed Anindya as Ketum Kadin invalid and illegal.

Hamdan said the Munaslub violated Law Number 1 of 1987 concerning the Chamber of Commerce and Industry (UU Kadin), Presidential Decree No. 18 of 2022 concerning Amendments to Kadin's Basic Budget and Household Budget (AD/ART).

"In answering the issue of whether the Munaslub last Saturday was legally justified and the provisions of the legislation, we must refer to and prioritize the Kadin Law No. 1 of 1987, Keprres 18/2022, and AD/ART of the Indonesian Chamber of Commerce and Industry," Hamdan said in an official broadcast by the Indonesian Chamber of Commerce and Industry.

According to the Chamber of Commerce and Industry's AD/ART, the Munaslub was held to hold the board of directors accountable for violations of principles against AD/ART, misappropriation of finances and organizational treasury, or non-function of the Board of Management so that the provisions of the AD/ART and National Conference's decision were not carried out properly.

The implementation of the Munaslub must also be preceded by a Letter of First and Second Warning, in which the Board of Management is given 30 days each to improve.

"So, the provisions in Article 18 paragraph (1) are not fulfilled with the absence of an answer from the Indonesian Chamber of Commerce and Industry Management Board, in this case by Arsjad Rasjid as the legitimate Chairman of Kadin," said Hamdan.

"The failure to fulfill this provision is reinforced by the rejection of the 21 Provincial Chamber of Commerce and Industry on the results of the 2024 National Conference with the agenda of determining Anindya Bakrie as the elected General Chair," continued Hamdan.
