KPU Confirms Draft PKPU Draft Nomination Of Regional Heads Leaking To The Public

JAKARTA - Member of the Indonesian General Elections Commission (KPU) Idham Holik confirmed the draft related to the Draft General Election Commission (PKPU) Regulation on Regional Head Candidacy in the 2024 Pilkada contestation which was allegedly leaked and circulated in public on Saturday morning, referring to the Constitutional Court's (MK) decision.

Idham when confirmed by Antara, Saturday, August 24, said the basis for making the PKPU draft was the Constitutional Court Decision Number 60/PUU-XXII/2024 and the Constitutional Court Decision Number 70/PUU-XXII/2024.

The Constitutional Court's Decision Number 60/PUU-XXII/2024 changed the nomination threshold for regional heads from 20 percent to 7.5 percent of vote acquisition in the previous legislative election, while the Constitutional Court Decision Number 70/PUU-XXII/2024 determined that the age requirements for regional head candidates were taken during the determination by the General Elections Commission (KPU).

He explained that the Constitutional Court Decision Number 60 was a reference in compiling drafts related to the threshold for nomination of regional heads as stipulated in Article 11 paragraph 1 where there were four classifications of the amount of valid votes set by the Constitutional Court, namely; 10 percent, 8.5 percent, 7.5 percent and 6.5 percent.

"The Constitutional Court Decision Number 60/PUU-XXII/2024 is a legal reference for the preparation of Article 11, Article 13 paragraph (1) letter d and related articles," said Idham.

Then, continued Idham, the Constitutional Court's Decision Number 70 was also a reference in compiling drafts related to the age of candidates for regional heads calculated during the determination of candidate pairs in Article 15.

"Furthermore, the legal consideration of the Constitutional Court's Decision Number 70/PUU-XXII/2024 is the legal basis for the preparation of norms, which contains Article 15 in the PKPU Draft to change PKPU Number 8 of 2024," he said.

As for Monday, August 26, the KPU and Commission II of the DPR RI will discuss PKPU Number 8 of 2024 concerning the Nomination of Regional Heads against the Constitutional Court Decision Number 60/PUU-XXII/2024 and the Constitutional Court Decision Number 70/PUU-XXII/2024.

Earlier on Thursday, August 22, the Indonesian KPU ensured that the registration of candidate pairs for regional head in the 2024 Pilkada would be guided by KPU regulations (PKPU) which had been equipped with new provisions in accordance with the decision of the Constitutional Court (MK) which was read out on Tuesday, August 20.

"What is certain is that later on August 27' 29, when registration of regional head candidates in all regions in Indonesia, they will follow the rules or PKPUs in which the articles or decisions of the Constitutional Court have been included," said Chairman of the Indonesian KPU Mochammad Afifuddin at the KPU RI Office, Jakarta, Thursday 22 August.

Afif also ensured that the Constitutional Court's decision adopted into the PKPU revised draft was not only a matter of candidate age requirements and the nomination threshold, but also included campaign rules in universities which were also amended by the Constitutional Court.

Meanwhile, the draft PKPU, which is suspected of being leaked, contains regulations related to the threshold for nominating regional heads, which are regulated in Article 11 paragraph 1.

For example, Article 11 paragraph 1 point a (1) states that for the provincial elections with a population of more than 6,000,000 (six million) people, up to 12,000,000 (twelve million) people, political parties participating in the election or a combination of political parties participating in the election must get a valid vote of at least 7.5 percent) in the province.

Regarding the age of the candidate for regional head, Article 15 of the PKPU is regulated and refers to the Constitutional Court Decision Number 70/PUU-XXII/2024. Article 15 reads "The minimum age requirement is 30 (three) years for Candidates for Governor and Deputy Governor and 25 (twenty five) years for Candidates for Regents and Deputy Regents or Deputy Mayor Candidates as referred to in Article 14 paragraph (2) letter d as of the determination of Candidate Pair".
