Mahfud Asks KPU To Immediately Implement The Constitutional Court's Decision To Change The Threshold Of The Regional Head Elections

JAKARTA - Former Chief Justice of the Constitutional Court (MK) Mahfud MD said the General Elections Commission (KPU) must immediately implement the Constitutional Court Decision Number 60/PUU-XXII/2024 regarding the threshold for nomination of heads and deputy regional heads in the regional elections.

"So that people in the area are calm. There are still nine days left to prepare everything, and so that it is remembered that the Constitutional Court's decision has been in effect since the hammer was hit," Mahfud said in the Senen area, Jakarta, Tuesday, August 20, was confiscated by Antara.

According to Mahfud, the Constitutional Court's decision must be applied to the 2024 Pilkada because the previous election results in question are the 2024 General Election.

"The previous election is now (the 2024 election). Therefore, it must be carried out as well as possible," he said.

Meanwhile, Mahfud said that the Constitutional Court's decision was a good and democratic thing, so as to minimize the potential for empty boxes to occur.

Moreover, he said, a decrease in the threshold had been conveyed by him in a Hearing Meeting at the DPR RI in 2018.

"First, I used to talk about the threshold (border) for the president (pilpres). Then second, talk for the regional elections. If the individual candidates can be 6 percent, for example, or 10 percent allowed, then political parties and the combination can be 10 percent because they are more real," he said.

He continued, "Therefore, in my opinion, the political party is aligned with the individual candidates for the requirements, and this is what I have said before because it has never created justice."

Previously, the Constitutional Court stipulated that political parties or coalitions of political parties participating in the election could register candidate pairs if they met the following requirements:

To propose a candidate for governor and deputy governor:

a. Provinces with a population of up to 2 million people on the voter list, political parties or coalitions of political parties participating in the election must get a valid vote of at least 10 percent in the province

b. Provinces with a population of more than 2 million people on the voter list, political parties or coalitions of political parties participating in the election must get a valid vote of at least 8.5 percent in the province

c. Provinces with a population of more than 6 million people to 12 million people, political parties or coalitions of political parties participating in the election must get a valid vote of at least 7.5 percent in the province.

d. Provinces with a population of more than 12 million voters, political parties or coalitions of political parties participating in the election must get a valid vote of at least 6.5 percent in the province.

To propose candidates for regent and deputy regent, as well as candidates for mayor and deputy mayor:

a. Regencies/cities with a population of people added to the voter list remain up to 250 thousand people, political parties or coalitions of political parties participating in the election must get at least 10 percent of the valid votes in the district/city

b. Regencies/cities with a population of more than 250 thousand to 500 thousand voters, political parties or coalitions of political parties participating in the election must obtain a valid vote of at least 8.5 percent in these districts/cities.

c. Regencies/cities with a population of more than 500 thousand to 1 million voters, political parties or coalitions of political parties participating in the election must obtain a valid vote of at least 7.5 percent in these districts/cities.

d. Regencies/cities with a population of more than 1 million voters, political parties or coalitions of political parties participating in the election must get a valid vote of at least 6.5 percent in the district/city.
