Prosecutors Free Caretakers Of Islamic Boarding Schools Whose Santri Laws With Hot Water

The Head of General Crimes at the Kudus District Attorney's Office, Tegar Mawang Dhita, accompanied by the Head of Subsidy for Pre-Demanding Viola Oksianta, showed restorative justice documents for the caretakers of Islamic boarding schools in Kudus, Central Java/ANTARA/Akhmad Nazaruddin Lathif.

The Kudus District Prosecutor's Office, Central Java, has stopped the legal process against one of the caregivers of the Anfaul Ulum Kudus Islamic Boarding School for cases of violence against students until the student's finger was injured due to the punishment of being smeared in hot water.

"The application of restorative justice to the perpetrator who is the caretaker of the boarding school named A. Syaefudin from Kajar, Dawe District, Kudus after obtaining approval from the Attorney General's Office," said Head of General Crimes at the Kudus District Attorney's Office, Tegar Mawang Dhita, as reported by ANTARA, Monday, August 19.

Previously, he said, the Kudus Prosecutor's Office submitted a request to the Central Java High Prosecutor's Office, then forwarded it to the Attorney General's Office for case exposure purposes.

Because the request was granted, he said, the case was closed so that the suspect was free from criminal charges. In fact, victims of violence with the suspect have also reconciled.

Meanwhile, the suspect also provided compensation to the victim's family amounting to Rp. 30 million.

After that, a letter of termination of prosecution (SKP2) was issued as of August 16, 2024 so that the perpetrators could be released because previously they were deposited in the Class II B Kudus Detention Center as detainees entrusted by the Kudus District Attorney.

As for the considerations of the Holy Prosecutor's Office, among others, because it is the first time the perpetrator has committed a crime with a penalty of under 5 years, the victim and his family have forgiven the suspect's actions, as well as paying attention to the condition of the victim's family and the suspect.

The violence experienced by the students began when the suspect found cigarettes, tobacco, and vape in the room of the third floor of the Anfaul Ulum Islamic Boarding School. The suspect asked all male students. It turned out that the victim was one of the students who owned cigarettes, tobacco, and vape.

For this incident, the perpetrator ordered the victim to put his hands in a basin filled with hot water which had been mixed with cold water for approximately 15 seconds while saying the words "if God's pandemic violates the boarding house regulations again, then I am ready to be punished".

After giving the punishment, the perpetrator then met the victim in the room and saw the victim's hands were red, swollen, and swollen, then his parents took the victim home.

For his actions, the perpetrator was charged with Article 80 paragraph (2) in conjunction with Article 76 C subsidiary Article 80 paragraph (1) jo. Article 76 C of Law Number 35 of 2014 concerning Amendments to Law no. 23/2002 concerning Child Protection.
