MATARAM - The public prosecutor charged the Director of PT Gerbang NTB Emas (GNE) Samsul Hadi with the Director of PT Berkah Air Laut (BAL) William John Rajadhi to carry out groundwater exploitation activities in the Gili Trawangan and Meno tourist areas without permission.

"That due to the exploitation of PT GNE in collaboration with PT BAL without a SIP (dafport permit) and SIPA (earthwater utilization permit) there has been environmental damage," said Danny Curia Novitawan representing the public prosecutor's team reading the indictment at Samsul Hadi's inaugural trial. and William John aired at the Mataram District Court reported by ANTARA, Thursday, June 20.

The prosecutor conveyed the emergence of environmental damage due to unlicensed exploitation activities based on the results of a check and analysis by geologists from the Bandung Institute of Technology (ITB).

The results of the expert check are also listed in the indictments of the two defendants. One of them stated that there was a fairly high level of salt in the production of groundwater from PT BAL and PT GNE.

"In the long term, it is concluded that experts can result in degradation of the quality of the soil and groundwater around the drilling area," said the prosecutor.

The prosecutor in the indictment also stated that PT BAL as the technical executor of the provision of drinking water for the people in Gili Meno and Trawangan built two bore well locations.

"One (boring well) is in Gili Meno and the other is in Gili Trawangan," said the prosecutor.

For joint business activities in accordance with the agreement between PT BAL and PT GNE, it was revealed in the indictment that Samsul Hadi as Director of PT GNE had received a distribution of the proceeds from the sale of clean water from PT BAL worth Rp1.25 billion.

The profit figure received by the director from the regional company owned by the NTB Provincial Government was conveyed by the prosecutor from mid-November 2019 to the end of October 2022.

This was conveyed by the prosecutor in accordance with proof of bank transfer from William John airing as Director of PT BAL to Samsul Hadi, Director of PT GNE.

From the description of the indictment, the prosecutor charged the two defendants with violating Article 70 letter D in conjunction with Article 49 paragraph (2) of the Republic of Indonesia Law Number 6 of 2023 concerning the stipulation of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation and/or Article 68 letters A and B as well as Article 69 letters A and B of Law Number 17 of 2019 concerning Water Resources jo. Article 56 of the 2nd Criminal Code.

After listening to the reading of the indictment, the two defendants through legal counsel stated before the panel of judges to file an exception on the public prosecutor's indictment.
