The Constitutional Court Does Not Ban Judge Arsul Sani From The 2024 Legislative Election Dispute Session From PPP

JAKARTA - Spokesperson for the Constitutional Court (MK), Fajar Laksono, confirmed that his party did not prohibit onstitutional judge Arsul Sani from hearing disputes over the results of the legislative general election (PHPU), including disputes filed by the United Development Party (PPP).

The Constitutional Court, said Fajar, believes that Arsul Sani will be objective in examining, adjudicating and deciding the PPP Legislative Election dispute, which is his former party.

"Yes, so far there is nothing," said Fajar Laksono, Sunday, April 28.

Fajar asked the public and litigants not to worry about Arsul Sani's objectivity in handling cases. Moreover, before the trial, constitutional judge Arsul Sani had been sworn in in order to be able to try the case as fairly as possible. "There is no provision, Mr. Arsul is nothing. That he was a PPP person first, now he has become a judge, he has been sworn in," said Fajar.

Furthermore, Fajar emphasized that there are no rules that prohibit Arsul Sani from participating in the 2024 Legislative Election dispute. Moreover, he said, the Constitutional Court itself has divided the trial into three panels with the composition of the three judges in each panel.

According to him, if Arsul Sani is prohibited from dealing with the 2024 Legislative Election dispute, it could result in the trial not running smoothly.

"It will make it difficult or at least the trial will run smoothly. For example, in one of the panels there is Mr. Arsul who is not allowed, while two (panels) are running, even though at least there must be three panel sessions. That means he is waiting for the two panels to be completed, then there is a judge to replace him. That needs more effort, "concluded Fajar.

It is known that Arsul Sani has officially become a constitutional judge or MK since January 18, 2024, replacing Wahiduddin Adams, who is serving his full term because he has entered retirement age for 70 years.

Arsul Sani is one of the judges proposed by the DPR. Before becoming a judge at the Constitutional Court, Arsul Sani was the deputy chairman of the PPP and a member of Commission III of the DPR.
