KPU Values Petitum Anies-Muhaimin's Lawsuit On Intervention To The Constitutional Court For Serious Allegations

The legal team of the General Elections Commission (KPU) alluded to one of the petitums of Anies Baswedan-Muhaimin Iskandar's lawsuit which stated that there was intervention to the Constitutional Court (MK).

The intervention in question is when the Constitutional Court issued a decision that allowed regional heads not yet 40 years old as presidential and vice-presidential candidates, so that Gibran Rakabuming Raka passed.

According to the KPU, the assumption that the Constitutional Court can be intervened by Anies-Muhaimin as the applicant for the lawsuit is a serious accusation.

"The Petitioner alleges that there is an intervention in the noble Constitutional Court. So the constitutional court is also being argued, Your Honor," said KPU Legal Team Chairman Hifdzil Alim at the Constitutional Court hearing, Thursday, March 28.

In the contents of the lawsuit, Anies-Muhaimin said that the 2024 presidential election fraud was also carried out by President Joko Widodo through his intervention to the Constitutional Court.

Anies-Muhaimin also considered that those who granted the Constitutional Court's decision number 90/2023 regarding the age of the presidential and vice-presidential candidates were the minority of the total panel of judges at the Constitutional Court. This is because 2 judges who expressed different opinions in the concurring opinion are considered the same as granting it.

From this, the KPU asked the Constitutional Court to also respond to the allegations of the intervention mentioned.

"The petitioner (Anies-Muhaimin) is not the authority of the respondent (KPU) to answer it. However, this has become a serious accusation against the constitutional court and has become the domain of the constitutional court to respond to the petitioner's accusations," he said.
