JAKARTA - The National Narcotics Agency (BNN) supports the decision of the Constitutional Court (MK) which rejects the request for legalization of marijuana from the parents of children who have been cerebrally paralyzed or paralyzed since childhood.

"I see based on medical and ethical considerations about this cannabis ban," said Head of the Indonesian National Narcotics Agency (BNN) Martinus Hukom quoting Antara.

From a medical point of view, he assessed that excessive use of marijuana would affect human nerves. In addition, from various studies, Martinus revealed that there was no medical advantage regarding the use of marijuana.

Meanwhile, in an ethical way, he said the influence of marijuana was extraordinary, causing dependence on its users.

"Then what is the reason if you want to legalize it? There is no reason, both medical and ethical," he said.

Previously, the Constitutional Court rejected the argument for the application submitted by Pipit Sri Hartanti and Supardji for the test of Law (UU) Number 8 of 1976 concerning the ratification of the 1961 Narcotics Single Convention along with the protocol that changed it. Pipit and Supardji are the parents of the Shita Aske Paramitha who have had cerebral stalls since childhood.

Reading the legal consideration of Case Number 13/PUU-XXII/2024, Constitutional Justice Guntur Hamzah in the plenary Court courtroom, Wednesday (20/3), stated that class I narcotics (polities and their derivatives) can only be used for the purpose of developing science and cannot be used in therapy.

The reason, he said, this has the potential to be high, resulting in dependence as emphasized by the Constitutional Court Decision Number 106/PUU-XVIII/2020 which states that there is no comprehensive proof of assessment and research (after the decision) on the use of marijuana or cannabis for health services.

Therefore, the Constitutional Court reiterated that the government should immediately conduct a special assessment regarding the use of marijuana for medical purposes in Indonesia so that the issue can be resolved immediately and answered rationally and scientifically.

Studies are needed considering that more and more people's aspirations are increasingly related to the need for the use of marijuana for health interests and humanitarian reasons.
