Class Action Is An Alternative If The Right To Question And Lawsuit Of The Constitutional Court Cannot Dismantling Election Fraud

Political observer Eep Saefullah views that the public can sue through class action in investigating allegations of fraud in the 2024 General Election. According to him, this can be done if the right to inquiry or lawsuit to the Constitutional Court (MK) fails to reveal the alleged fraud.

Eep said, in submitting the right to inquiry, the public could file a civil lawsuit regarding the election results to the election organizers.

"Actually, when the election occurred and then the crime occurred, the ones who were very aggrieved were the voters. And these voters took the civil path by holding a class action," said Eep in a statement received on Sunday, March 10.

Eep said that the class action lawsuit could increase pressure for the authorities to carry out an investigation. The public can demand public losses related to cheating in the 2024 election because it has an impact on democratic life in the future.

Class action can put greater pressure on authorities to investigate and ensure the integrity of the election process," he said.

Eep admitted that so far there have been no recorded cases of elections being sued with class action. But reflecting on similar lawsuits, the civil route is available for the public interest.

To note, this civil lawsuit must be fronted by all mature strategies. Plaintiffs need to determine the class action material and who is the target. In the context of general elections, this certainly involves people who feel aggrieved by the election process who are suspected of being disabled.

"When the material is clear and the clarity is now available, actually. Everyone feels aggrieved by the election implementation, the process and the results are flawed," explained Eep.

Then, there needs to be a strong and committed organization to carry out this class action lawsuit properly. Continuous and hard work, according to him, is needed to ensure that the legal process can run smoothly and effectively.

Then, Eep emphasized that the diversification of participation from various regions in Indonesia is an important thing to strengthen this class action lawsuit. This is because allegations of fraud are also spread in many regions.

"We have technology that makes people in Sumatra, in Kalimantan and Sulawesi, Nusa Tenggara, and everywhere can send their signatures as a class action," he said.
