TERNATE - As many as four defendants who gave bribes to the inactive Governor of North Maluku (Malut) Abdul Gani Kasuba (AGK) underwent the first trial of alleged corruption in the bribery project for the procurement of goods and services as well as granting permits within the North Maluku Provincial Government
They are the Head of the North Maluku PUPR Service, Daud Ismail; Head of the North Maluku Perkim Service, Adnan Hasanudin; and two private parties, respectively, the External Director of PT Trimegah Bangun Persada Tbk, Stevi Tomas; and the President Director of PT Birinda Perkasa Jaya, Kristian Wuisan.
In this trial, the public prosecutor (JPU) of the Corruption Eradication Commission (KPK) Muhammad Hatta Ali accused the defendant Ismail of giving money in stages to AGK amounting to Rp3 billion.
The bribe was intended for AGK to maintain the position of defendant Ismail as Head of the North Maluku PUPR Service and appoint the defendant as Acting Task Force and obtain extraordinary promotion recommendations in an open selection.
"Daud Ismail is suspected of committing several related acts in such a way that it must be seen as a continuing act, giving or promising something, namely that the Defendant has given money in stages with a total amount of Rp. 3,012,340,400.00 to the AGK as Governor of North Maluku, based on the Decree of the President of the Republic of Indonesia. With the intention that the AGK maintains the position of defendant for the head of the North Maluku PUPR, appoints the defendant as Acting Head of the PUPR Service and provides recommendations for an extraordinary promotion to the Defendant as a condition for participating in the open selection of the Primary High Leadership Position for the position of the Head of the North Maluku Provincial PUPR Service, "said Hatta Ali in a trial at the Corruption Court at the Ternate District Court, North Maluku, Wednesday, March 6, confiscated by Antara.
Meanwhile, the defendant Stevi Thomas was charged with giving AGK USD 60. The effort was to make it easier for AGK to issue technical recommendation permits.
"Giving or promising something, namely the Defendant has given money in stages with a total amount of USD 60,000.00 or around that amount, to the Civil Servant or State Administrators, namely to Abdul Gani Kusuba as Governor with the intention that the civil servant or state administrator do or do not do something in his position that is contrary to his obligations, namely that the money is given with the intention that the AGK as the Governor of North Maluku Province provides convenience in issuing permits and technical recommendations from the North Maluku Provincial Government Regional Apparatus Organization (OPD) under its structure, related to technical permits and recommendations submitted by companies under Harita Group," continued Public Prosecutor Hatta Ali.
Stevi's actions are considered by the prosecutor to be contrary to the obligations of the AGK as the State Administrators not to commit acts of corruption, collusion and nepotism as stipulated in the provisions of Article 5 number 4 and Article 5 number 6 of the Republic of Indonesia Law Number 28 of 1999 concerning the Implementation of a State that is Clean and Free from Corruption, Collusion and Nepotism in conjunction with Article 76 paragraph (1) letters a and e of Law Number 23 of 2014 concerning Regional Government.
Meanwhile, the defendant Kristian Wuisan was charged by the Public Prosecutor with giving money in stages with a total of Rp. 3,505,000,000 to the AGK as the Governor of North Maluku Province.
"Something that is contrary to obligations, is carried out or not in his position, namely because Abdul Gani Kasuba as the Governor of North Maluku Province has provided work packages within the North Maluku Provincial Government from 2020 to 2023 to the Defendant, by arranging the tender/procurement process at the Goods and Services Procurement Work Unit (UKPBJ) of the North Maluku Provincial Government Secretariat," he said.
"In addition, it is contrary to the obligations of the AGK as the State Administrators not to commit acts of corruption, collusion and nepotism as stipulated in the provisions of Article 5 number 4 and Article 5 number 6 of the Republic of Indonesia Law Number 28 of 1999 concerning the Implementation of a State that is Clean and Free from Corruption, Collusion and Nepotism in conjunction with Article 76 paragraph (1) letter a and e of Law Number 23 of 2014 concerning Regional Government as amended by Law Number 9 of 2015 concerning the Second Amendment to Law Number 23 of 2014 concerning Regional Government," continued the Public Prosecutor.
Responding to him, the defendants Daud Ismail and Kristian Wuisan rejected the indictment. Both filed an exception at the next trial.
