BTS Kominfo Case, President Director Of PT BUP Yusrizki Muliawan Sentenced To 2 Years In Prison

JAKARTA - Defendant of corruption in providing 4G Base Transceiver Station (BTS) infrastructure and supporting infrastructure packages 1, 2, 3, 4, and 5 BAKTI of the Ministry of Communication and Information (Kominfo) for the 2020-2022 period, Muhammad Yusrizki Muliawan, was sentenced to two years in prison.

The defendant Yusrizki, who is the Director of PT Basar Utama Prima (BUP), was also subject to a fine of Rp250 million, a subsidiary of four months in prison.

"The defendant was sentenced to two years in prison and a fine of Rp. 250 million provided that if the fine was not paid, it would be replaced with imprisonment for four months," said Chief Judge Rianto Adam Pontoh at the Corruption Court (Tipikor), Jakarta, Wednesday, February 28, confiscated by Antara.

Yusrizki was also sentenced to an additional penalty in the form of payment of replacement money in the amount of Rp. 61,179,000,000. However, the replacement money was compensated for with the money that had been confiscated from the defendant during the trial process.

"The replacement money was compensated for with the money that had been confiscated from the defendant and PT Bintang Komunikasi Utama, with a total of Rp61,179,000,000, to be subsequently confiscated for the state and taken into account as payment of money to compensate for the country's financial losses," said the judge.

In addition, the panel of judges ordered the public prosecutor to unblock Yusrizki's account.

"Declaring that the defendant Muhammad Yusrizki Muliawan is legally and convincingly proven guilty of committing corruption together as in the indictment of the subsidiary of the public prosecutor," said Rianto.

The judge's consideration in aggravating the sentence was because Yusrizki's actions did not support the government's program in eradicating corruption.

Meanwhile, mitigating factors include the defendant feeling guilty and admitting his actions and voluntarily returning the money that was corrupted.

"All power system procurement work in the 4G BTS project has been completed by subcontractors. Most of the 4G BTS projects have been completed and have been inaugurated by the President of the Republic of Indonesia on December 28, 2023, and have provided benefits to the Indonesian people," continued the judge reading the mitigating considerations.

The verdict of the panel of judges is lighter than the demands of the public prosecutor. Previously, Yusrizki was sentenced to imprisonment for four years and six months; paid a fine of Rp. 500 million, subsidiary to six months in prison; and paid compensation of Rp. 61,179,000,000.

Based on the verdict, both Yusrizki and the public prosecutor stated that they would think about filing an appeal first.

In the case that cost the state finances Rp8,032,084,133,795.51 (Rp8.3 billion), Yusrizki, who is the Director of PT Basar Utama Prima, was charged with receiving money amounting to 2.5 million US dollars and Rp84.17 billion.
