Not The ITE Law, The Police Are Investigating This Allegation In The Aiman Witjaksono Case Calls The Police Not Neutral

Metro Jaya Police stated that they did not find any elements of violations of the ITE Law in Aiman Witjaksono's statement that the police were not neutral in the General Election or the 2024 General Election. However, from the results of the case title, it was found that the alleged crime of spreading false news was found.

The ITE Law was originally one of the articles included in the six police reports (LP) received by Polda Metro Jaya.

"From the results of the title of the case, the increase in the status of the investigation is an investigation, that no criminal events were found as referred to in the ITE Law," said Director of Special Criminal Investigation at the Metro Jaya Police, Kombes Ade Safri Simanjuntak, quoted on Sunday, January 7, 2024.

In the case title process which was carried out on December 27, 2023, it was only found that there were allegations of violations of the spread of fake news. Currently, the investigation process is ongoing.

"The title forum has agreed to increase the status of the investigation to investigate two alleged criminal acts that occurred, Article 14 and Article 15 of Law Number 1 of 1946 concerning Criminal Law Regulations," he said again.

For the development of the investigation, investigators have scheduled an examination of the witnesses. However, it was not detailed about the number and identity of the witness in question.

"An investigation plan has been made, and in the next 1 or 2 weeks, we have scheduled an examination of all witnesses that we have clarified at the previous stage of the investigation," said Ade.

As a reminder, there were six community groups who reported Aiman Witjaksono as the National Winning Team Bica Officer or TPN Ganjar-Mahfud to Polda Metro Jaya following his statement about the police not being neutral in the 2024 General Election.

In the six LPs, Aiman is suspected of violating Article 28 (2) in conjunction with Article 45 Paragraph (2) of the Republic of Indonesia Law Number 19 of 2016 concerning amendments to Law of the Republic of Indonesia Number 1 of 2008 concerning ITE and/or Article 14 and/or Article 15 of Law Number 1 of 1946 concerning Criminal Law Regulations.
