The panel of judges sentenced the Director of PT Anugrah Mitra Graha (AMG) Po Suwandi, who was accused of corruption in the iron sand mine in the Dedalpak Block, East Lombok Regency, West Nusa Tenggara, to 13 years in prison.

"The defendant Po Suwandi was sentenced to 13 years in prison and a fine of Rp. 500 million, subsidiary to 6 months in prison," said Isrin Surya Kurniasih as chairman of the panel of judges when reading out Po Suwandi's sentence at the Corruption Court at the Mataram District Court, reported by ANTARA, Friday, January 5.

In addition to the main sentence, the judge also charged the defendant to pay compensation for state financial losses of Rp17.7 billion. The determination of this replacement money refers to the results of the NTB BPKP audit which released state financial losses of Rp36.4 billion.

If within 1 month of the decision with legal force the defendant is still unable to pay the replacement money, the prosecutor will confiscate and auction off the defendant's property to cover the cost of the replacement money.

"However, if the defendant's property cannot be sufficient to pay the replacement money, the defendant must replace it by serving a sentence of 6 years," he said.

The judge also determined that the public prosecutor should use a deposit of Rp. 820 million from the defendant Po Suwandi when the case was still under investigation and was included in the calculation of the payment of compensation for state financial losses.

The judge stated that the defendant's actions as Director of PT AMG violated Article 2 paragraph (1) in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001 jo. Article 55 paragraph (1) of the 1st Criminal Code in accordance with the first indictment of the public prosecutor.

The judge stated this by saying that the defendant was the first person to be responsible for mining PT AMG's iron sand in the Dedalpak Block in 2021 and 2022 without obtaining approval of the planned activity and budget (RKAB) from the Indonesian Ministry of Energy and Mineral Resources.
