Ministry Of Home Affairs Delays Replacement Of 3 Regents In West Kalimantan

PONTIANAK - The Ministry of Home Affairs (Kemendagri) has postponed the replacement of three regents in West Kalimantan Province (Kalbar) and will be carried out in accordance with the date of their inauguration based on the decision of the Constitutional Court (MK) RI in 2023.

"Previously, the end of the leadership period of the three regents will end on December 31, but because it has been issued from a letter from the Minister of Home Affairs to postpone it, follow up on the Constitutional Court's decision on the demands of seven regional heads who feel aggrieved because their positions are less than five years," said Acting Governor of West Kalimantan Harisson in Pontianak. reported by ANTARA, Friday, December 29.

The three regents in West Kalimantan whose replacements have been postponed are Mempawah, Sanggau and Kubu Raya, and will be replaced after their leadership period ends according to their inauguration date.

The positions of the three regional heads will end according to their inauguration period, namely Mempawah Regency on April 14, 2024, Sanggau on February 17, 2024, and Kubu Raya Regency on February 17, 2024.

Harisson explained that the Constitutional Court (MK) officially granted the lawsuit of Deputy Governor of East Java (Jatim) Emil Dardak regarding Article 201 paragraph (5) of the Pilkada Law regarding the end of the term of office of regional head for the 2018-2023 period which should have ended on December 31, 2023. However, with this decision, three regents in West Kalimantan canceled their term of office at the end of this year.

In the ruling of the Constitutional Court Number 143/PUU-XXI/2023, in essence, it provides a new norm based on the provisions of Article 201 paragraph (5) which states Article 201 paragraph (5) of Law 10/2016 which originally reads "Governor and Deputy Governor, Regent and Deputy Regent as well as Mayor and Deputy Mayor as a result of the 2018 election in office until 2023", which reads "Governor and Deputy Governor, Regent and Deputy Regent as well as Deputy Mayor and Deputy Mayor as a result of the 2018 election and inauguration will serve until 2023 and the Governor and Deputy Governor, Regent and Deputy Regent and Deputy Mayor as well as Mayor and Deputy Mayor of 2018 election results. 2018 whose inauguration will be held for 5 (five) years from the date of inauguration as long as it does not pass 1 (one) month before holding a nationally simultaneous vote in 2024".

Harisson said that regarding the position of regional head in West Kalimantan, which will also be completed after that, he will follow the procedure as stated in the Constitutional Court's decision.

"It's not reduced. If the Sambas and Bengka Regencies are different again. That's because we will have the 2024 election, then they will be finished, so that by January 2025, we already have new governors, regents, mayors at one time," he said.
