Escaped The Death Penalty, 3 TNI Members Of The Killer Of Imam Masykur Sentenced To Life In Prison

JAKARTA - The panel of judges at the Jakarta Military Court II-08 sentenced three TNI soldiers to life sentences who were proven to have committed premeditated murder of civilian Imam Masykur.

The verdict was read by Chief Judge Colonel Chk Rudy Dwi Prakamto during a trial at the Jakarta Military Court II-08, Cakung, East Jakarta, Monday, December 11.

According to the panel of judges, the three defendants were legally and convincingly proven guilty of committing a criminal act, premeditated murder carried out together as the first primary indictment, namely Article 340 of the Criminal Code in conjunction with Article 55 paragraph (1) 1st of the Criminal Code.

Second, the act of kidnapping was carried out jointly as stated in Article 328 of the Criminal Code in conjunction with Article 55 paragraph (1) 1 of the Criminal Code.

"The defendants were sentenced, Defendant 1 (Praka Riswandi Manik) to a basic sentence of life imprisonment, Defendant two (Praka Heri Sandi) the main sentence of life imprisonment, and Defendant three (Praka Jasmowir) the main sentence of imprisonment for life," said Rudy.

The three defendants also received additional penalties fired from military service, especially the Indonesian Army.

The judge's decision was lighter than the demands of the Jakarta Military Oditur which charged the three defendants with the death penalty at the previous trial on Monday (27/11).

Praka Rismwandi Manik is a member of Paspampres, Praka Heri Sandi is a member of the Topographic Directorate of the Indonesian Army, and Praka Jasmowir is a member of the Iskandar Muda Regional Military Command.

The panel of judges also stated that they did not find any reason to forgive and the right reasons for the actions of the defendants.

Hearing the verdict, the defendants looked down.

The panel of judges also gave the three defendants the opportunity to respond to the judge's decision.

The defendants' attorneys will also think first regarding the judge's decision. Likewise, the Military Oditur also conveyed the same thing.

The panel of judges gave one week to decide what legal steps to take regarding the judge's decision.

Also present was Imam Masykur's biological mother, Fauziah, who also presented testimony at the witness examination hearing in the case.

The criminal act took place on August 12, 2023 and the victim's body was dumped at 01.00 WIB August 13, 2023 in the Purwakarta area, West Java.

Imam Masykur's body was found by a 9-year-old child in the Citarum River. Imam's body was found caught in a hyacinth on the surface of the river which is about five meters deep.

The child reported to adults around the river, namely Perum Jasa Tirta who rested around the riverbank.

Imam Masykur's family reported the kidnapping and torture of Imam to the Polda Metro Jaya. The report from the family was based on the contents of the message, telephone, and video call from the victim and the perpetrators to the Imam Masykur's family during the torture and kidnapping.

The report was received by the police with the Number STTLP/B/4776/VIII/2023/SPKT. From the victim's family report to the police, the Military Police of Kodam Jaya started the legal process for the three TNI AD soldiers on August 14, 2023.

The three soldiers are known to have extorted and kidnapped cosmetic shopkeepers around Jabodetabek, including Imam Masykur. The cosmetic shop is a cover to sell G-class drugs (hard drugs that require a doctor's prescription) illegally.

It is believed that Praka Riswandi and his friends often target illegal drug shops under the guise of cosmetic shops to extort sellers or shopkeepers.
