No Need To Debate Again, Prabowo-Gibran Has Legal And Political Legitimation

JAKARTA - Constitutional Law expert Yusril Ihza Mahendra confirmed that the presidential and vice presidential candidate pair number 2 Prabowo Subianto and Gibran Rakabuming Raka already have legal and political legitimacy that is strong to fight in the 2024 presidential election. According to Yusril, political and legal legitimacy is important in Indonesia as a democratic law country.

Yusril said the winner of the automatic election would obtain political legitimacy because the majority of the people chose it. Meanwhile, legal legitimacy, he said, relates to the issue of whether power is legal or not seen from the legal and constitutional points.

"In the presidential election, political legitimacy and legal legitimacy are important, and Prabowo-Gibran from the nomination process to the current campaign stage actually has both legitimacy," said Yusril in the ILDES webinar themed Upaya Delegitimasi Kemenangan Capres-Cawapres Pilpres 2024.

Yusril revealed that the Constitutional Court's decision Number 90/2023 became Gibran's basis as a vice presidential candidate, and there was a KPU decision regarding the ratification of the candidate pair. The two bases are the legal and constitutional basis for the nomination to be valid and legitimate.

According to Yusril, the Constitutional Court's decision on the basis of Gibran running for vice president is a binding and final decision. He acknowledged that aspects of legal certainty and justice are important in the practice of state administration.

However, Yusril reminded that the aspect of legal certainty must be put forward, even though the aspect of justice that will continue to be questioned by various parties.

"Currently, it is not necessarily a win, but there is a political delegitimation movement against power that might win this presidential election fight, and this is what is always echoed," said the deputy chairman of the Steering Committee of the Prabowo-Gibran National Campaign Team (TKN).

Furthermore, Yusril said that political legitimacy takes time. However, he said, legal legitimacy will be completed and strong when the inauguration of the president and vice president in October 2024.

"History of our presidential election is like that, indeed officials have been sworn in, but there are still movements that try to disturb him, but in the end the movement is dim and the political legitimacy is full to the official in power," concluded Yusril.
