Supreme Court Cancels Free Sentence Of Lombok Hajj Dormitory Project Corruption Defendant

The Supreme Court Judge canceled the acquittal of corruption defendants in the rehabilitation and maintenance of the Lombok Hajj Embarkation Dormitory building, West Nusa Tenggara, Dyah Estu Kurniawati, who acted as director of the project implementing company.

Spokesperson for the Mataram District Court Kelik Trimargo confirmed the information based on the receipt of a decision from the Supreme Court.

"Yes, according to the decision we received from the Supreme Court, the first level court decision was canceled by self-trialing the case," said Kelik as quoted by ANTARA, Tuesday, October 10.

According to the verdict on September 14, 2023, he said, the judge himself tried the Dyah Estu case by imposing a prison sentence of 4 years and a fine of Rp. 300 million, subsidiary to 4 months in prison.

With the receipt of a decision from the Supreme Court, his party will follow up by informing the defendant and public prosecutor.

"Because we just received an excerpt this morning, no later than tomorrow we will continue notification to the parties," he said.

In the first instance court, the panel of judges stated that Dyah Estu's actions as Director of CV Kerta Agung were not proven to have committed a criminal act of corruption in the project that took place in 2019.

According to the judge, there were no facts that stated that Dyah Estu enriched himself or someone else or a corporation according to the indictment of Article 2 paragraph (1) of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001.

Likewise with the abuse of authority regulated in the indictment of Article 3 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law no. 20 of 2001.

The judge also stated that no facts were revealed regarding Dyah Estu's involvement in a corruption case that had cost the state Rp2.65 billion according to the results of an audit by the NTB Representative Financial and Development Supervisory Agency (BPKP).
