Amiruddin's Ex-Head Of The BNI Mataram Branch Becomes 9 Years In Prison At The Appeal Level

NTB - The West Nusa Tenggara (NTB) High Court (PT) handed down an appeal sentence from 8 years to 9 years in prison for the former Head of the BNI Mataram Branch (Kacab) Amiruddin.

Amirudin is a defendant in the corruption case of the people's business credit fund distribution program (KUR) in East Lombok Regency in 2020-2021.

"Furthermore, we will notify the public prosecutors and defendants at this appeal level," said Mataram District Court spokesman Kelik Trimargo in Mataram, Thursday, August 31.

Kelik said that if the defendant Amiruddin is not satisfied with the decision on the appeal verdict of PT NTB, he is welcome to take further legal action at the Supreme Court (MA) cassation level.

"The parties can submit a cassation request to the clerk of the district court within 14 calendar days starting from the time the parties receive notification of the appeal decision," he said.

The panel of judges of PT NTB in the decision of Amiruddin's case number: 7/PID.TPK/2023/PT MTR, tried by accepting appeal requests from the defendant and public prosecutor and amending the court's decision at the first level regarding the main sentence.

With this decision, the panel of judges at the appeal level stated that the defendant was proven to have participated in a criminal act of corruption in accordance with the public prosecutor's primary indictment.

The primary indictment of the public prosecutor regulates Article 2 paragraph 1 in conjunction with Article 18 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law Number 20 of 2001 jo. Article 55 paragraph (1) 1st of the Criminal Code.

To the defendant, the panel of judges also sentenced him to 9 years in prison and a fine of Rp. 500 million, subsidiary to 4 months in prison.

Regarding state losses amounting to Rp29.6 billion, the panel of judges agreed with the decision of the first level court which had charged another defendant, namely Lalu Irham Rafiuddin Anum with a value of Rp29.1 billion.

The amount of loss charged to other defendants was the result of a reduction in credit repayment money by 14 debtors with a value of Rp476 million and the money that was still deposited in the debtor's account amounted to Rp7.9 million.

The panel of judges at the first level considered the figure as a total loss from the transfer of KUR funds belonging to 779 corn farmers in East Lombok Regency to the account book of PT Mitra Universal Group (MUG) owned by the defendant Lalu Irham Rafiuddin Anum.
