LPSK Call Immoral Victims Former Members Of The NTB DPRD Have The Right To Receive Restitution

JAKARTA - Chairman of the Witness and Victim Protection Agency (LPSK) Hasto Atmojo Suroyo said immoral victims, former members of the West Nusa Tenggara Provincial DPRD (DPRD NTB), are entitled to receive restitution.

"Restitution can be submitted by the victim. Because the perpetrator is the victim's biological father, while the victim's mother is being treated, a request can be submitted by the institution, in this case the Mataram Police and the calculation of restitution submitted to the LPSK," said Hasto.

Hasto said that Mataram Police investigators were obliged to inform victims about the rights of children who were victims of criminal acts to obtain restitution and the procedure for filing it.

The rights of victims regarding restitution are regulated in Government Regulation (PP) of the Republic of Indonesia Number 43 of 2017 concerning the Implementation of Restitution for Children Who Are Victims of Criminal Acts.

"As parents, the perpetrator has an obligation to his biological child. However, as a perpetrator of sexual violence against children, the perpetrator can also be prosecuted to pay restitution to the victim's child," said Hasto.

Hasto regretted AA's conduct of sexual violence against his biological child. According to him, as a former public official the perpetrator's actions were very embarrassing.

"We think that the steps taken by the investigators to secure the perpetrator are appropriate to prevent intimidation of the victim. Moreover, the victim is the perpetrator's biological child whose economic needs still depend on the perpetrator," he said.

On the other hand, continued Hasto, the victim's biological mother, as reported, had to be treated for exposure to COVID-19. Such conditions make the position of the victim difficult. In fact, now the victim has to legally face her own father.

"LPSK is ready to provide protection for child victims. Those concerned can access services from the state, including medical assistance, psychological rehabilitation and other assistance," said Hasto.

The former member of the NTB Provincial DPRD with the initials AA has been named a suspect for committing immoral acts against his biological child. The victim is the biological child of AA's second wife. Regarding the incident, the victim reported to the Mataram Police on Tuesday, January 19, or the day after receiving lecherous treatment from his father.

Hasto emphasized that the LPSK paid special attention to this case because of sexual violence, including a certain criminal act that received priority protection from the LPSK.

Hasto hopes that investigators and prosecutors will charge the perpetrator with a harsh sentence accompanied by other weighty sentences, given the status of the perpetrator is the victim's biological father.

"If his actions are proven and the perpetrator is found guilty, the judge is expected to negate the perpetrator's right to get remission," he said.
