Jember District Court Judge Sentenced To 4 Months Defendant With Disabilities In Theft Case

The panel of judges at the Jember District Court sentenced a disabled person named Sutono who was a defendant in a theft case.

"The defendant was legally and convincingly proven to have committed a criminal act of theft with weight, thus imposing a sentence on the defendant with a prison sentence of four months," said Chief Justice Aryo Widiatmoko as quoted by ANTARA, Tuesday, May 2.

The defendant Sutono, who is a deaf and speech disabled person from Kalisat District, Jember Regency, was previously charged with violating Article 363 Paragraph (1) 3rd, 5th, so that the public prosecutor (JPU) of the Jember Kejari charged the defendant with imprisonment for four months.

The judge's decision was in accordance with the demands submitted by the Public Prosecutor's Office of Jember in the previous trial, so that the Public Prosecutor accepted the decision and did not appeal.

The panel of judges also stated that the period of arrest and detention that Sutono had served was deducted entirely from the sentence imposed, so that the defendant was immediately released because he had served four months in prison at the Class II-A Jember Prison.

"Ordered the defendant to be immediately expelled from detention and the defendant is also required to pay a court fee of Rp5,000," he said.

The evidence in the case was in the form of two units of loudspeakers returned to the Sinowardi victim, while one catapult belonging to the defendant Sutono was confiscated for destruction.

The defendant's legal adviser stated that he accepted the verdict after discussing with the defendant's family and the prosecutor Luh Putu Denny Witari's side also stated that he accepted the judge's decision, so that the decision had been inkrached or had permanent legal force.
