Allegedly Legal Defects In The Case Of Hasya Athallah's Death, A Student Who Was Hit By A Police Retired Car

JAKARTA - The University of Indonesia Alumni Association (ILUNI UI) and the legal team M Hasya Athallah, FISIP UI students who died when they were hit by a retired police car, Eko Setia Budi, in Srengseng, South Jakarta, are still conducting studies regarding the pretrial plans to be submitted.

"The matter of pretrial is still under the study of the legal team," said Hasya's family Advocacy Team, Indira Rezkisari when confirmed by VOI, Monday, January 30.

Meanwhile, according to Rian Hidayat, as the Advocacy Team for Hasya's case from ILUNI FHUI stated the same thing. According to him, the legal team is still reviewing Hasya's accident case.

"Again, we are studying with the team, but we have tried (pretrial)," he told VOI.

The Adovocacy Team suspected that there was a legal defect in the process of investigating Hasya's death case due to a traffic accident.

"We are concerned that if Hasya becomes a suspect, the information about the start of Hasya's investigation to become a suspect when? Moreover, making a suspect is tantamount to claiming his human rights. But this is the condition of the victim and has died (in fact he is a suspect), that is our question," he said.

Rian also questioned the police regarding the determination of the suspect's case against Hasya.

"Our question is, when did Hasya become a suspect. Why was the victim made a suspect and SP3 is because the suspect or victim Hasya died," he admitted.

In fact, the advocacy team who are members of ILUNI UI also saw an alleged irregularity in the case that befell Hasya. Especially with the determination of the suspect against the victim who actually died.

"Simply like this, when there is a collision case, of course, to determine whether it is wrong or not, it is in court. So when it does not enter the court, why? Moreover, because the suspect, or the victim for us died. Why did this not continue the process to court?," he regretted.

Previously, the police advised Muhammad Hasya Atallah Saputra's family to file a pretrial if they were not satisfied with the decision to determine the suspect and terminate the investigation process.

In the case of the accident, Hasya was named a suspect even though she was killed because she was hit by a retired police officer with the initials ESBW.

"Maybe in this process, if the party is not satisfied, they can file a pretrial," said Traffic Director of Polda Metro Jaya Kombes Latif Usman to reporters, Friday, January 27.

According to Latif, the process of determining the suspect was based on the investigation process according to the rules. Of course, by referring to the evidence found.

"So there is a legal mechanism, of course, based on the new evidence owned by the parties," said Latif.
