JAKARTA - The Witness and Victim Protection Agency (LPSK) said the victims of sexual violence that occurred at the Indonesian Good Morning School Foundation (SPI) Batu, Malang, East Java, had the right to apply for restitution rights to the perpetrators.

"LPSK has calculated the losses suffered by the victims for the crimes they suffered," said LPSK Deputy Chair Antonius PS Wibowo in a written statement, Friday, July 8.

As is known, the defendant JE and the owner of the SPI School Foundation are still breathing free air. In fact, JE's legal process has entered the trial stage with the agenda of examining witnesses.

LPSK views that the victims of JE's crimes, namely SDS (22) and JH (21) have the right to apply for restitution to the perpetrators. In addition, the defendant is considered to have to get a maximum sentence.

Moreover, one of the victims at the time of the incident was still a child. "The perpetrator is an educator or person who is given a position as a caregiver. So, he deserves to be given a punishment," said Antonius.

He mentioned the restitution proposed at around Rp. 60 million. This amount is based on the calculation of the LPSK. Antonius, based on the report Antara, hoped that the panel of judges who heard the case would also revoke the school permit in question, but still guarantee the continuity of the students' education.

He explained that the case of sexual violence at the SPI School Foundation was based on a power relationship, considering that the perpetrator was the owner of the foundation. The modus operandi of the perpetrators is to recruit workers by looking for prospective applicants from students/school students.

"The perpetrators used the victim's trust and power over the victim to rape and obscenity," he also said.

LPSK is worried that the perpetrators, who have not been arrested, have used their strength to carry out a series of intimidations against the victim.

He reminded those who try to hinder the legal process against perpetrators of sexual violence can be sentenced to a maximum imprisonment of five years as stipulated in Article 19 of Law Number 12 of 2022 concerning the Crime of Sexual Violence (TPKS).
