Proven Corruption Of IDR 639 Million BOS Fund, Former Principal Of SMAN 8 Medan Sentenced To 5.5 Years In Prison

MEDAN - The panel of judges at the Medan District Court (PN) sentenced the former head of SMA Negeri 8 Medan, Jongor Ranto Panjaitan, to 5 years and 6 months in prison. The judge stated that the defendant was guilty of misappropriating the School Operational Assistance (BOS) fund of Rp 639,630,500.

In his decision, Chief Justice Eliwarti stated that the defendant's actions were proven to have violated Article 2 paragraph (1) in conjunction with Article 18 of Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption.

"The defendant was sentenced to 5 years and 6 months in prison," said Eliwarti in a trial held in room 8 of the Medan Corruption Court, Monday, June 13.

Not only that, Jongor was also sentenced to a fine of Rp. 200 million subsidiary with the stipulation that if the fine was not paid, it would be replaced with a sentence of 2 months in prison.

The panel of judges also sentenced Jongor to an additional penalty of paying compensation for state financial losses of Rp. 639,630,500.

"With the provision that one month after the case has permanent legal force, the convict's property is confiscated and then auctioned off. If later it is not sufficient to cover the replacement money, then the sentence is 2 years in prison," he said.

The judge's decision was much lighter than the demands of the Public Prosecutor (JPU) from the Medan Kejari, Fauzan Irgi Hasibuan. Previously, the Public Prosecutor demanded that the defendant be sentenced to 7 years and 6 months in prison and a fine of Rp. 300 million, subsidiary to 3 months in prison.

In addition, the prosecutor from the Medan Kejari also demanded that the defendant pay a replacement money (UP) of Rp. 1,458,883,700. If the defendant does not pay the replacement money and the property is not sufficient, then it is replaced with a prison sentence of 4 years.
