Observer: Police Have Take Correct Steps And According To The Law In The Incident In Wadas

JAKARTA - Police observers, Inspector General Pol. retired. Sisno Adiwinoto views that the police and related agencies have carried out their duties and obligations in Wadas Village, Purworejo Regency, Central Java, in accordance with the mandate of the constitution and laws.

"In my opinion, all police officers and related agencies are 'white goats' who have carried out their duties and obligations in accordance with the mandate of the constitution and the law," said Sisno Adiwinoto in his statement, quoted from Antara, Saturday, February 12.

According to Sisno, the case in Wadas that occurred a few days ago when some people criticized and framed stories (framing) related to the implementation of the duties of the Indonesian National Police was caused by a lack of proper understanding from the community or the police themselves regarding the task of maintaining security and public order (harkamtibmas). ).

"The police were present in Wadas Village in order to assist and secure BPN officers, the BBWS Serayu Opak, the PUPR Service, and the Agriculture Service to carry out land measurements as well as plant inventory and whatever is on the land of the dam project site, not to siege Wadas Village. " he said.

Sisno also views that the dam project is one of the national strategic projects so that it is actually the duty of all components of society to make its construction successful.

Furthermore, in carrying out the duties of harkamtibmas, said Sisno, members of the National Police can carry out police discretionary actions in accordance with their authority. This means that members of the National Police can make parameters so that there is no physical contact clash between the contra and the pros.

"Police members can act as long as these actions can be categorized as 'other actions according to the law that are responsible' as regulated in the Criminal Procedure Code," said Sisno.

He said that they were making arrests in order to temporarily secure someone or several parties.

In carrying out the duties of Harkamtibmas, he said, the police in accordance with their authority can indeed carry out arrests with the aim of not being processed in the criminal justice system.

On the other hand, arrests are an effort to prevent clashes between residents in the community.

"It can be done as long as the action can be categorized as 'other actions according to the law that are responsible' as a condition for carrying out police actions according to their own judgment in accordance with Article 18 of Law Number 2 of 2002," said Sisno.

In Article 18 paragraph (1) of Law Number 2 of 2002 concerning the National Police it is stated that for the public interest, officers of the State Police of the Republic of Indonesia in carrying out their duties and authorities may act according to their own judgment.

According to him, problems can indeed arise because all police actions must be legally accountable, including the arrest.

Sisno said that the community who felt a loss had the right to sue the police through pretrial legal remedies. On the other hand, the police are also entitled to submit arguments regarding the use of police discretionary powers.
