JAKARTA - Coordinating Minister for Political, Legal, and Security Affairs Mahfud MD emphasized that the case of alleged gross human rights violations in Paniai, Papua, which was raised to the level of investigation by the Attorney General would be processed according to the applicable law.

"The Attorney General has raised it to the level of investigation by appointing 22 prosecutors. So, this will be processed according to the applicable law," said Mahfud MD, quoted by Antara, Monday, December 6.

In following up, he said, the process will adhere to Law (UU) No. 26/2000 on the Human Rights Court.

One of the things explained in it, said Mahfud MD, is the qualification of a gross human rights violation which is only determined and decided by Komnas HAM.

In addition, he added, cases of gross human rights violations that occurred before 2000, precisely before the enactment of Law No. 26 of 2000, would be submitted to the Indonesian House of Representatives for analysis regarding the adequacy of the evidence.

If the DPR finds sufficient evidence, the case will be brought to court.

"Then, cases of human rights violations that occurred after Law Number 26 were handled and analyzed and followed up by the Attorney General's Office and coordinated with Komnas HAM," continued Mahfud MD.

The Coordinating Minister for Political, Legal, and Security Affairs also said that the government, in accordance with the mandate of the legislation, was preparing a draft law on the Truth and Reconciliation Commission.

"In the past, we had Law Number 27 of 2004 concerning the Truth and Reconciliation Commission, but it was canceled in 2006 by the Constitutional Court," said Mahfud MD.

Thus, the government prepared the bill as a replacement regulation.

"Those are the solutions for gross human rights violations," said Mahfud MD.

As explained by Mahfud MD, the alleged case of gross human rights violations in Paniai was a case announced in 2020 by Komnas HAM.
