JAKARTA - Commission X of the House of Representatives (DPR) considers that the Regulation of the Minister of Education and Culture for Research Technology (Permendikbud Ristek) Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence in higher education should be limited. The reason is that the Permendikbud, Research and Technology, is considered problematic and reaps a polemic.

"There is nothing wrong with Mas Nadiem (Mendikbud, Research, and Technology) quickly revising this limited Permendikbud to further emphasize consensual norms so that they have more binding power, so that anyone who wants to have sexual intercourse can be prevented," said Chairman of Commission X DPR Syaiful Huda in his statement, Tuesday, November 9.

According to Huda, the definition of sexual violence in Permendikbud Number 30 of 2021 gives rise to multiple interpretations. Because he said, the definition of sexual violence in the Permendikbud was not clear enough.

He said the consensual norm which is the dominant factor to judge whether or not sexual violence occurred should be emphasized in binding force.

Therefore, the consent of both parties in having sexual relations must be linked in official rules, both in terms of state and religious norms so that the legal force is binding.

"Don't let the agreement be returned to each individual because it could be when you say consensual it doesn't really become a consensus," he explained.

The PKB Party politician explained that the trend of sexual violence on campuses has also increased. The reason, he said, is that sexual violence in universities does not only occur among students, but is often perpetrated by unscrupulous lecturers and campus employees.

Based on the data he obtained, 174 cases of sexual violence on campus were recorded in 79 campuses and 29 cities. "Actual cases could be much higher because many cases go unreported because victims feel embarrassed or because of other factors," he said.

Huda said the Permendikbud for Research and Technology was made because the number of sexual violence on campus was still high. However, he denied that this Permendikbud, Research and Technology was considered to legalize free sex.

"We consider the perception of Permendikbud 32/2021 as a tool to legalize free sex to be too excessive. All parties should agree that sexual violence needs to be addressed firmly and Permendikbud 32/2021 is a form of attitude," said Huda.

Previously, PKS Party also wanted Permendikbud, Research and Technology Number 30 of 2021 concerning PPKS in Higher Education to be revoked. PKS believes that this Ministerial Regulation of Education and Culture and Research and Technology must be in line with Article 31 of the 1945 Constitution.

"Permendikbud, Research and Technology No. 30/2021 must be revoked and immediately revised and completed. This Permendikbud must be in line with Article 31 of the 1945 Constitution which assigns the government to seek and organize a national education system, which increases faith and piety as well as noble character in the context of the intellectual life of the nation," said member of Commission X DPR from the PKS faction, Fahmi Alaydroes, at the DPR Building, Monday, November 8.

Fahmi admitted that the intention of the Minister of Education and Culture, Research and Technology, Nadiem Makarim, was good, because he wanted to eliminate the problem of sexual violence in the campus environment. However, according to him, this Permendikbud, Research, and Technology does not cover immoral issues.

"Unfortunately, this regulation does not at all reach or touch the issue of immoral violations that are very likely to occur in the university environment, including the practice of adultery and same-sex (or) LGBT sexual relations," said Fahmi.
