Agnez Mo Uploads Candra Darusman's Explanation Regarding Who Must Pay Royalties

JAKARTA - The legal case between Agnez Mo and Ari Bias Despite being in the civil realm in fact has caused widespread debate among Indonesian music personnel.

On the one hand, Ari Bias's lawsuit was granted, deemed a 'victory' of songwriters in fighting for his economic rights.

On the other hand, the decision of Agnez Mo as a copyright violator - for using songs commercially without a permit is considered to be able to damage the existing order and cause a domino effect where songwriters are busy suing singers.

A direct statement from Agnez and his attorney regarding the decision of the Central Jakarta Commercial Court is the most awaited, but the 38-year-old singer has not spoken at all.

However, through his social media accounts, Agnez has responded several times to statements by several senior musicians, such as Melly Goeslaw.

Most recently, Agnez, via uploading Instagram Story, shared a statement link from Candra Darusman on Facebook.

Musicians who have held positions at the World Intellectual Property Organization (WIPO) or the World Intellectual Property Organization, try to share their views on who should pay royalties in a music show.

"Unlike other economic exclusive rights, this right (the Right to Announce) is collectively managed by the Collective Management Institute (LMK) on the grounds that it is inefficient if the individual creator travels around the country to collect this type of right," wrote Candra Darusman.

He also explained the difference between the 'user' and the 'player' contained in Law No. 28 of 2014 concerning Copyright (UUHC).

"The definition of song use in commercial activities is the party that organizes activities, not the singer or band (the perpetrators)," he said.

The political position of the Copyright Law Indonesia adheres to the rule that people (the individual or legal entity) can use songs in performances as long as they reward the creator through LMK - as deputy songwriters. In Indonesia its implementation is through the national LMK / LMKN (for one door). In other words, People are organizers, namely Event Organizer (EO) / promoter / committee. Not the culprit.

Furthermore, Candra gave a long description of her views regarding royalties in music performances. He also hopes that the singer and songwriter can synergize.
