JAKARTA - The Central Jakarta Commercial Court has decided to grant the lawsuit filed by Arie Sapta Hernawan alias Ari Bias against Agnes Monica Muljoto alias Agnez Mo.

As is known, Agnez Mo was sued for using the Ari Bias song entitled 'Just Ticket', without permission.

In its decision, the panel of judges stated that Agnez Mo was proven to have violated copyright for the song Kata Saja created by Ari Bias.

"The point is to state that the defendant (Agnez Mo) has committed copyright infringement because he has used commercially the song created by the plaintiff (Ari Ordinary), "Just Ticket", at three concerts without the plaintiff's permission," said Minola Sebayang as Ari Bias' attorney, at a press conference in Fatmawati, South Jakarta, Monday, February 3.

The decision granted Ari's lawsuit asking Agnez to pay a loss fine of Rp. 1.5 billion.

"Punishing the defendant using the song created by the plaintiff commercially without a permit of Rp. 1.5 billion," added Minola.

Attorney Ari Bias said the fine value of the loss was obtained from Agnez Mo's appearance in three different cities, with each appearance subject to a fine of Rp. 500 million.

"The concert on May 25, 2023 at HW Superclubs Surabaya is Rp. 500 million, concerts on May 26, 2023 at D-Club Jakarta are Rp. 500 million, concerts on 27 May 2023 at HW Superclub Bandung are Rp. 500 million. Jafi totals Rp. 1.5 billion," he said.

Minola stated that the decision on the amount of the loss fine by the panel of judges referred to Article 113 of the Copyright Law.

"So this is also a debate, people ask why one fine violates 500 million. Where did the calculations come from? I conveyed it, because it is regulated in Article 113 of the Copyright Law," he concluded.
